A grand jury in Ontario County, N.Y., decided Wednesday not to file criminal charges against the Nascar champion Tony Stewart for the Aug. 9 accident that killed driver Kevin Ward Jr.

The grand jury had been asked to consider charges of second-degree manslaughter and criminally negligent homicide after Stewart’s racecar hit and killed Ward during a sprint car race at Canandaigua Motorsports Park. District attorney Michael Tantillo said more than two dozen witnesses testified, including two accident reconstruction specialists. The grand jury also reviewed a number of photographs and video recordings.

This is great news. He didn't intentionally kill Kevin Ward, Jr. It was an accident. They happen sometimes with tragic consequences.

Its sad and will haunt Stewart for many years. But I don't think there was any intent past maybe roostertailing him.
 
That is good news. I never understood the desire to prosecute. You walk out on a field with racing cars....WTF do you think is going to happen.
 
Stewart may be an ass but he was innocent in this incident. As others have stated, you just can't waltz out into a race track with a race ongoing.
But am certain there is a line of lawyers at the door of the family to go for civil charges.

“There is toxicology evidence in the case relating to Kevin Ward that actually indicated that at time of operation he was under the influence of marijuana,” District Attorney Michael Tantillo said during a news conference Wednesday afternoon. The DA should be suspended immediately and brought up on charges (ethics, withholding evidence, sensationalizing/politicizing an investigation, etc).
 
There is no test which can test for marijuana intoxication. So, bull****.

Seriously? Toxicology is not advanced enough to tell if someone has been smoking weed? Really? That is what you are going to try to convince us of?

To those with the ability to read, he is trying to convince you about intoxication. Although he clearly did fail, the true fail is on your end. I blame your strawman :thumbs:

Frankly, don't know if he was high as a kite, but when your temper allows you to break from reality and walk into the middle of a race track with cars racing by.....seems like you have some huge issues.
 
Yes, this is how stupid pissing contests sometimes end. Not the driver's fault IMO.
 
You should direct that question to the person who made the claim (I would be interested in the answer as well):

He lied about what his source said since it did not use that term, but instead used what most would consider more moderate terms. Had he provided no source then he would have simply been providing a personal opinion rather than incorrectly attributing unsaid words or concepts to someone or something considered to be authoritative.

I will let the readers here make their own judgement as to whether his term is synonymous with the as-yet unproven terms that his source did use ("under the influence" and "impaired"), or if he was exaggerating/embellishing for effect and whether or not that technically qualifies as a lie, as opposed to being intellectually honest and simply using the exact terms that his source did use. That's how debates work (my goal is not to convince you).

When reporting on/incorporating the words of others it is best to use the same words that they used. Unless the intent is to misrepresent . . . .

Especially when the cars racing are open wheel and there are no fenders to prevent that kind of accident from happening... Walking out in the middle of the track during that type of racing was just asking for trouble.

Yep, the test can only determine if marijuana has been used, not if the subject is currently intoxicated. A heavy user could quit smoking for a month and still test positive for marijuana use. Even longer, actually.
 
I'm pretty sure that parents of a dead child are going to sue civilly a rich person that they view as the cause of that child's death.

They will not likely succeed considering Ward's toxicology report.
