Seattle court orders HIV-positive man to stop spreading the virus

Intentionally infecting people with HIV is an assault. This man is a criminal.

Assault? Try murder.
HIV/AIDS is a death sentence.

Could be attempted murder, but you can't prosecute someone for murder until the victim is actually dead and they caused it. For example, if this guy infected someone, and then that person died a week later from falling off a building, he couldn't be prosecuted for their death.

Several Canadians, both male and female, have been charged, tried, convicted and jailed for just such activity. Considering the harshness of some US laws and punishments, this seems incredible to me.

The US has a Constitution. There is no law forbidding anyone from engaging in sexual act. There is not law preventing anyone form spreading disease...even intentionally.

The judge can hold him in contempt and jail him...but only for a short time.

California code:

Cal. Health and Safety Code § 120290MisdemeanorAny person afflicted with any contagious, infectious, or communicable disease who willfully exposes him/herself to another person is guilty of a misdemeanor.

In Canada, we also have a constitution. However, there are laws requiring mandatory reporting related to HIV and AIDS as well as laws mandating that a carrier inform any sexual partner whether using contraceptives or not. Individuals who do not do so are open to criminal charges related to assault and reckless endangerment, and in the extreme case with murder.

I agree with that and I wish that was the case here in the United States, however we have laws here that protect this scumbag from even having his name known...
