That's right. The Bloomberg nanny state intrusion, however well intentioned, is dead. Long live personal freedoms.

ALBANY, N.Y. (AP) — New York's highest court has refused to reinstate New York City's ban on the sale of big sodas.

The state's Court of Appeals ruled Thursday that the city's health department overstepped its bounds when it restricted the size of sodas.

The court is siding with a lower court that overturned the 2012 ban. The city had hoped Thursday's ruling would reinstate the restrictions, which banned the sale of sugary drinks larger than 16 ounces.

Pushed by then-Mayor Michael Bloomberg as a way to fight obesity and other health conditions, the limits would apply to restaurants, delis, movie theaters, stadiums and street carts.
Restaurants, theater owners and beverage companies sued. They argued that New York City didn't have the authority to impose the ban. Court won't reinstate New York City's big-soda ban

Government assuming it has the authority to do whatever it pleases seems to be contracting. NYC being the testing grounds for such legislation was dealt a blow, and I think that's a good thing.

Obviously this court was paid for by the "Big HFCS" cabal, Diabetes Drug Companies and basically hates people. Without this ban, however will New Yorkers control themselves? However will they keep from drinking or eating too much?

Obviously there is shinnanigans going on and Obama should just pick up his pen and call the state of NY and tell them "it is so".

Some **** just shouldn't even have to go to court. **** like this, or like a case just decided by the Supreme Court concerning police officers needing a warrant or not to search your cell phone. Do you think judges sometimes sit there and think "WTF....why is this even making all the way to MY desk?".

Bloomberg's nanny statism is annoying beyond belief, starkly resembles prohibition, and is one of the least effective ways to reduce obesity. Good news.

Glad the badn is lifted.... Bloomberg was the WORST Left-Winged nanny state nutjob we've had running a big blue city in a while (Sorry Rahm.... you are gonna have to be runner-up). Glad SCONY (Supreme Court of New York) did a good job overturning this ruling although I have a question... what would have stopped me from buying a giant re-usable to-go container and then just filling it up with multiple sodas?

Judicial activism at its finest! :good_job:

Their new Mayor has yet to get started.

A strong since of law and order?

Chuck Norris was once bitten by a king cobra. After several days of writhing in agony, the cobra finally died.

I totally agree with the court.
But wow!
I am having more trouble reconciling that it has been that long since the ridiculous ban was instated.

Good. I've seen really stupid politicians have the audacity to push really stupid ideas, but that one took the cake.

What are they going to do - deny my treatment because I had a donut.... not unless the US becomes Cuba.

Or maybe raise your insurance rates?

The argument will be that since the government is responsible for paying for your health insurance they must be certain you maintain your health. Bloomberg was just a little bit ahead of his time.

There will also be social pressures to conform because others are paying for you abusing your health. As Johnny Cash once sang, "I don't like it but I guess things happen that way, badoom badoom".

Granted, that would be a responsible thing to do but then, someone's going to have to watch me 24x7x365 and count the donuts. Who's doing that? Theoretically I get where this is going but putting it into practice isn't very realistic.

Until full on socialism and government single payer is in full swing, we'll just have to buck up and deal with those radicals eating donuts. To celebrate I'm headed off to the bakery to get some of these... :2razz:

As a left-winger, I have to say Bloomberg and Emanuel are some of pretty much the worse politicians on my side of the political spectrum. Half of the left is terrible anyway. I thought the same thing about the loophole you mentioned. I don't think they banned refills either, so you could essentially have the same amount of soda anyway.

Just want to point out that the courts decision doesn't address the freedom/nanny state issue. It's more about administrative law.

Just don't pay with a credit card and you can gorge yourself on all the good stuff you want!

They already have cameras on every street corner of the UK but the Big Gulp may not yet have advanced there yet. How can people start their day without 32 ounces of that fine combination of sugar, water, caffeine and flavorings?

Which is none of the government's business.

Think of Republicans as your strict father. You are going to do what he tells you to do or he is gonna kick your ass, stomp you into the ground, and kill you. He is a mean spirited asshole. Now think of Democrats as your loving mother. She is gonna wrap her arms around you, protect you, and squeeze you to death. In the end, you die either way. From an ass kicking or a bear hug, it doesn't matter. You are dead. A little parenticide at this point wouldn't be a bad thing. LOL.

Another win for Liberty!

Was that a republican mayor trying to restrict freedom?!?!
