We're talking about something a little different here - in this case, in effect, it is the employee disciplining/firing the boss. And taking it further, it is equal partners in a corporation, each with equal voting shares/stock, voting to require one partner to divest himself of his shares in the corporation potentially at great loss and personal tax implications. I don't think this is the legal slam dunk, pun intended, that many think it is.

It's part of the contract he signs to be a member of the NBA and have his team play and make him those billions of dollars. While not everything in a contract is necessarily enforceable simply because you sign it willingly, I'm not aware of any particular law that would be broken by enforcing the contract against him.

He's not going to get top dollar because right now it's a damaged brand. In addition, the buyers know he's in a tough spot so the can low ball him. Finally, he's going to have to pay taxes on the capital gain. All in all, it's going to cost him tens of millions and maybe even more than 100 million

Or, so now he's only going to be worth 1.8 billion?

That article doesn't make it seem nearly as positive for Sterling as you do.

Nothing looks positive for Sterling. However, according to the article it looks like he could possibly have the NBA in court for the rest of his life, something the NBA I'm sure doesn't want. From everything I've read this issue appears to be a long way from being over.

It's not going to significantly impact him financially either, even with the capital gains taxes he would have to pay from the sale.

I have reviewed Donald Tokowicz comments and believe he must be mentally ill. He is married, is 80 years old, jewish, and dating a woman half his age who is half-black and half-mexican. He does not care if she sleeps with black men but insists that she cannot "bring black people to the game" or post instagrams with black men in them.

I want to know why she can't bring black people to the game but he is perfectly fine with her sleeping with black men. If he was "racist" you'd think that he would have a problem with his mistress sleeping with black men. But he doesn't care about that, he just doesn't want her to bring blacks to the games. I don't get it.

I really have mixed emotions on this issue...What Sterling said was horrible and a truly racist statement but on the other hand what happened to the first amendment and freedom of speech especially in the privacy of his home that you on the left are always citing?

The first amendment doesn't apply here since the government was not involved.

He still is free to speak....he just has to pay the consequences of his speech, he agreed to follow the rules of the NBA and the they decided to hold him to it.
Where this happened is irrelevant.

Let me take a shot at this.

The woman, and I am using that term loosely here, is supposedly with him. Everybody seems to know that.

If she brings blacks to the games or posts pictures of herself with blacks on her instagram, whatever that is, people call Sterling about her. I am sure the call is something about the woman using him for his money and he is a chump and just generally to give him ****.

He would prefer that she did not make it so obvious that she is with other men while she is with him. I can't say I blame him.

Now you are going to say why he specified blacks, right? In the recording when she asked if it was Ok if she took pictures with whites or brought them to the game, he didn't answer that. He said something like, I see what you are trying to do.

He didn't say it was OK for her to do those things with whites but not blacks.

If my girlfriend was doing something that caused me to get a rash of ****, I would also ask her not to do it because I don't have the time to deal with **** like that.

This is just my take on this.

Others may think differently.

If he had said it publically, probably. It would piss me off more that my g/f secretly recorded the conversation and released it to the press. I would spend as much as I had to, to make sure she waited tables for thevrest of her life.

What happened to him isn't right because it was illegal surveillance, but because he is a public figure with a franchise he does have to be careful. I'm not a big fan of the PC movement and the "destroy the view that offends us" mentality but right now it is prevalent. The guy is a jerk, he had a right to say it, and the league has a right to protect itself.

The best thing they could do is just let the guy implode, as long as people know that he holds those opinions his team's leverage is shot in the market so he'll probably sell naturally as it devalues. If they start voting people out..............well, everyone could get a turn at the chopping block sooner or later for just about anything.

I don't know either but it seems to me the man has been an owner for 33 years, there has only been one incident that I'm aware of where racism was claimed against him related to the team and that was with Elgin Baylor who was fired and by all accounts was a horrible GM. It is also true that the rules of "ownership" may have been altered several times during his 33 years owning the team and he may not have voted for any of the changes and this may be the first time he's had issue to challenge those rules in court. It is also true, at least in my view, that it would be impossible for an owner of a business to be banned for life from entering the establishment and participating in running that business. A court may be able to do so, but an employee of a corporation banning a boss - can't see it standing up. Finally, I can't see a business, outside of a court ruling, being forced to divest itself of assets, potentially at significant loss.

I fully support a significant suspension and fine for the man, but this is over the top - I also find it extreme as a first penalty - and I also find it extreme considering the lack of NBA league action against others with similar views who participate in and attend their games, including the owner of the Orlando Magic and his anti-gay views.

I'm not so sure the NBA can punish Sterling either. I tried to find the NBA constitution online and wasn't able to, it's apparently a super secret document but I did find this

I'm not sure if article 35 is what Silver used as his only justification but it looks pretty clear to me that article 35 refers to disciplining of players, not owners.

Once again.....people trying to claim "free speech" in supporting racism, bigotry and intolerance. Why do you guys always try to shirk personal responsibility? No one is infringing on Sterlings Free Speech rights. He remains free to say whatever the hell he wants. What he isn't free to do....is be free of the consequences that come as a result of his choosing to exercise his free speech rights.
