Maybe. Although it isn't known exactly known what rights owners waive in the NBA constitution, it is known that they waive some of their rights to sue the NBA. I doubt Silver would've done it if it were going to be relatively easy for Sterling to fight back.

This is in an area of law that lawyer love as it is all murky and they get to charge confiscatory rates and look legitimate doing so.

Excellent article - thanks for sharing. I personally hope Sterling takes the NBA to court. I particularly like the part were the author mentions that Sterling, having owned the Clippers for 33 years, probably has had conversations with other owners during which they may have made similar or other racist or derogatory comments and the threat that such would be exposed in court may cause the owners to back down.

Don't even get me started on that one man. The whole point of surveillance law is that one must be licensed in the state they want to conduct it in(P.I.) and even then there are limitations. For official surveillance like police or any other agencies there is supposed to be probable cause, a warrant issued, and other protections to insure that the person being watched isn't having their rights violated in the process.


I'm with you brother, unless the NSA is monitoring this conversation. If so, I fully support their admitted indiscriminate need to search for terrorists by collecting millions of innocent people's (non-suspects) electronic communication; just in case with a snowball's chance in Hell, one day they might need it. :ssst:

I'm somehow starting to think you don't understand what the Constitution does.
Well you can think all you want whatever you want but not even the rules of a corporation can violate an individual's rights to their property. As the owner of the clippers he has been banned from all NBA activities he can no longer watch a game of the team he owns. I see that as a property rights violation.
Let's define personhood.- "Persons" are one of the two main classes which are the subject of rights, powers, and duties, the other being "citizens". Persons may be "natural" or "corporate". "Citizens" are a subclass of "natural persons". Each government may also establish, within its jurisdiction, "corporate persons" such as governmental entities, associations, trusts, corporations, or partnerships, in addition to the Common Law "natural" persons, but the "personhood" of such corporate entities is not created by the government. Its corporate personhood derives from the personhood of its members. Corporate persons must be aggregates of natural persons. Corporate persons must aggregate not violating individual basic natural rights. Sterling is an asshole but an asshole with rights. The NBA in its attempt to distant itself from a known racist may have gone over the top and violated Sterlings constitutional rights in the process.

Property rights are not enshrined in the constitution. Donald Sterling does not have a right to own an NBA team. He entered into a voluntary arrangement, and he broke the terms of that arrangement.

(1) A private residence, from which others may be excluded.

(2) Tools needed for one's livelihood.

(3) Personal property, which others may be denied the use of.

(4) Arms suitable for personal and community defense.

A corporation does not have the right to deny one his natural rights

Well like the article said, which I tend to agree with, unless the League revokes his ownership then he will have a hard road. If it came to the League taking his ownership rights, I think he would win that one.

That's correct but they are part of the Declaration of Independence. The basis for the Constitution. They come from the philosophies of John Locke who the founders were very much influenced. And they are very much protected in the Fifth and Fourteenth Amendments.

Los Angeles Clippers owner Donald Sterling will be banned for life and fined $2.5 million for racist comments, NBA commissioner Adam Silver announced Tuesday.

The move comes after days of outrage at ugly words attributed to Sterling from a taped conversation with an ex-girlfriend.

The comments, where the owner seemed to say he didn't want his much-younger girlfriend hanging out with Black people on Instagram or bringing them to games, were first by TMZ and then in another recording posted on the website Deadspin.


The NBA had said it was unable to authenticate the tapes, but Sterling's wife told KABC-TV in Los Angeles that it was her husband on the recordings.

At a press conference on Tuesday afternoon, Commissioner Silver said an investigation had confirmed that the voice on the tapes and the "hateful opinions voiced" were those of Sterling.

He made PRIVATE remarks to his GF... she recorded them, perhaps illegally... she later released the tape probably in anger... and his private remarks (apparently never meant to be public) are the basis of a lifetime ban from the NBA?

Now someone tell me again what was done to Micheal Vick? :wassat1:

Maybe by your understanding, but we shall see where this goes. I'm sure there are some very smart constitutional experts all over this case. Considering the NBA's previous "actions" in regard to other owners and players, this one against Sterling will be seen unjust and unfair. If they think they have a PR problem now........just wait.

The NBA is awesome. This is the same NBA who let DeShawn Stevenson play even after pleading "no contest" to having sex with a 14 year old girl, who he got drunk.:thumbs:

Sterling can't dunk.
