Holding one person accountable for another persons debt in insane.


.....Congress quietly lifted the 10-year statute of limitations in 2011 on money owed to Uncle Sam.
Now, debts going back decades are considered fair game for the IRS, and the government is coming after the children and grandchildren of the original debtors for the repayment.
In some cases, debts of parents from the early 1960s and 70s are being collected from children.

Mary Grice whose father died when she was 4 years old in 1977, leaving her mother with five children. Thirty-seven years later, the Social Security administration is claiming that it overpaid someone in her family, but it isn't sure whom, and is going after Ms. Grice for the alleged debt.

I would like to find the bill and look and see the voting record on this.

What is worse is that in order to fight it they have to get a lawyer and file charges which cost even more then the amount owed.
there are also statute of limitations on such things, and they can only go after the estate while it is in probate. once out of probate they have no claim to file.

there are other legal protections out there is just takes them argued in the court.

The Congress removed the statute of limitations for this in 2011.

I guess when the government says it wants additional revenue not only do they mean it but they'll get it however they can.

The WaPo says:

"No one seems eager to take credit for reopening all these long-closed cases. A Social Security spokeswoman says the agency didn’t seek the change; ask Treasury. Treasury says it wasn’t us; try Congress. Congressional staffers say the request probably came from the bureaucracy.

The only explanation the government provides for suddenly going after decades-old debts comes from Social Security spokeswoman Dorothy Clark: “We have an obligation to current and future Social Security beneficiaries to attempt to recoup money that people received when it was not due.”

Since the drive to collect on very old debts began in 2011, the Treasury Department has collected $424 million in debts that were more than 10 years old. Those debts were owed to many federal agencies, but the one that has many Americans howling this tax season is the Social Security Administration, which has found 400,000 taxpayers who collectively owe $714 million on debts more than 10 years old. The agency expects to have begun proceedings against all of those people by this summer."

So, what we get is the nameless, faceless bureaucracy. What a crock....! The bill was passed in 2008, but the provision wasn't tapped until 2011....hmmmmm....Curious. But I just love the psychopathic bureaucrats like this woman at SSA, saying they have a duty to recoup money paid in overpayments.....45 years ago?!!!!! This is just a preview in my opinion of the authoritarian government we are headed for.

Thanks for the link, Pete. I'm still scrolling but had to give my bleeding eyes a break. Still haven't found the section, but I admit to scrolling fairly fast at this point. The scope of this bill is stunning.

Some more history of the 2008 farm bill...

"One version of this legislation, the Farm, Nutrition, and Bioenergy Act of 2007 was passed by the United States House of Representatives on July 27, 2007. Despite opposition from some senators, including a failed amendment proposal by Senator Richard Lugar and a veto threat by President Bush, the Senate version of the bill, called the Food and Energy Security Act, was passed by the Senate Agriculture Committee on October 25, 2007, and later by the full Senate on December 14.[3][4] In late April 2008, congressional negotiators finally reached a deal to reconcile the House and Senate bills. The deal increased spending on food stamps and other food programs while mostly maintaining the current farm subsidies, despite record farm profits.[5]
On May 15, the House and Senate passed the bill, but President Bush issued a veto on May 21. The House voted to overturn the president's veto shortly thereafter, and with the margins by which the bill was passed, a Senate override also occurred; so the Congress overrode the president's veto, passing the bill into law (Public Law 110-234, the Food and Energy Security Act of 2007).[6][7] However, the veto override was moot, as a 34-page section of the bill was omitted in the version sent to the White House. In effect, the President vetoed a bill Congress never considered. The bill had to be re-passed by Congress.[8]

President Bush again vetoed the measure, but this veto was overridden in both Houses on June 18, so the Farm Bill in its entirety became law.[9] A similar situation occurred in 2005 with the Deficit Reduction Act, where in the enrolling process certain mistakes were made changing the text of the bill. In that case, the bill was considered to be law even with the mistakes since the Speaker of the House and the President Pro Tem of the Senate attested that the language sent to the President was indeed the text that was passed by Congress.[citation needed].
The bill originally caused controversy because the "pay-as-you-go" (Clause 10 of Rule XXI of the Rules of the United States House of Representatives) rule was waived. That rule prohibits the consideration of bills that increase the deficit in either a six-year period or an eleven-year period. The bill itself did not cause such an increase if using a "baseline", which is an estimate of future revenue and spending levels of the U.S. government, that was issued in 2007. A more recent baseline, issued in 2008, showed a large increase in the deficit over the applicable time periods. While other points of order are waived under certain circumstances, the paygo point of order is rarely ignored."

So according to the article you reference these noble fighters for CONdom loaded the bill with pork, knowing the Dems would have to accept it if the Dems wanted to over ride the veto... :doh

So perhaps rather than a CONvoluted rewrite of history the lesson is just how self serving politicians can be.... errr just what lengths a politician goes to to 'take care' of people he represents (even if some are not back home but on K-Street) :peace

Yep, there were some republicans that voted with demo's to over ride the veto. I never said any different....But, the truth of the matter, is that although there are "progressive republican's" that sided with demo's to bring this into effect, the lengths that partisan hacks will go to, actually try and spin that a demo controlled house, and senate isn't responsible for crap like this is stunning....

Hell, to read your post rhine, you'd think that the demo's were the minority....:lamo Sad really. The truth of the matter is that as usual practice in DC, they didn't read the bill before jamming it through....now a familiar situation.

But clearly you think that taking someones tax refund for a 45 year old debt that their parents may, or may not have owed, they don't know because they can't find the record of it themselves, but you think that is just fine to take that from a lady that can't afford it....But I am sure "your for the people" right?
