Ways and Means Committee Refers Lois Lerner to Department of Justice for Criminal Prosecution | House Committee on Ways & Means

Washington, DC – Today, House Ways and Means Committee Chairman Dave Camp (R-MI) announced that the Committee, acting under its authority granted in Sec. 6103 of the Internal Revenue Code, voted out a criminal referral letter to Department of Justice (DOJ) Attorney General Eric Holder regarding actions taken by IRS employee Lois Lerner. Chairman Camp, in sending the letter on behalf of the Committee, urged Holder to take a serious review of the evidence uncovered through the Committee’s investigation to determine whether Lerner violated criminal statutes.

The Committee uncovered three specific acts undertaken by Lerner that may have violated one or more criminal statutes documented in the letter:
•Lerner used her position to improperly influence agency action against only conservative organizations, denying these groups due process and equal protection rights under the law. She showed extreme bias and prejudice towards conservative groups. The letter lays out evidence on how Lerner targeted conservative organization Crossroads GPS as well as other right-leaning groups, while turning a blind eye to similarly-organized liberal groups, like Priorities USA.
•Lerner impeded official investigations by providing misleading statements in response to questions from the Treasury Inspector General for Tax Administration (TIGTA).
•Lerner risked exposing, and may actually have disclosed, confidential taxpayer information, in apparent violation of Internal Revenue Code section 6103 by using her personal email to conduct official business.
If convicted of these crimes, Lerner could face up to 11 years in prison.

When it comes to insults and accusations in modern politics, few things are worse than being compared to Sen. Joseph McCarthy, whose unsubstantiated accusations in the 1950s against Americans he suspected of communism are widely seen as one of the darkest times in congressional history.

Now, ahead of a House Oversight Committee vote Thursday to hold former IRS official Lois Lerner in contempt, the committee's top Democrat, Elijah Cummings, D-Maryland, is accusing Chairman Darrell Issa, R-California, of engaging in McCarthyism.

And he's releasing a congressional study that he says proves it.

Cummings and fellow committee Democrats say Issa is trampling on Lerner's constitutional rights by holding her in contempt, even though she invoked her Fifth Amendment right not to testify.

Aides to Cummings provided CNN with findings from the nonpartisan Congressional Research Service that cited 11 times in modern history where witnesses were prosecuted for refusing to answer committee questions after invoking their Fifth Amendment rights.

The majority of the instances were in the McCarthy era against witnesses involving alleged communist activities.

"We oppose Chairman Issa's efforts to re-create the Oversight Committee in Joe McCarthy's image, and we reject his attempts to drag us back to that shameful era in which Congress tried to strip away the constitutional rights of American citizens under the bright lights of hearings that had nothing to do with responsible oversight and everything to do with the most dishonorable kind of partisan politics," said Cummings in a report he prepared for the committee's Democratic minority.

Cummings points to the service's research that none of the cases involving witness testimony was ultimately upheld in court.

Issa said records obtained last week from the IRS show communications from the office of ranking member Rep. Elijah Cummings, D-Md., about True the Vote, a Texas-based, nonprofit conservative group that aims to prevent voter fraud.

The communications at one point involved Lois Lerner, the ex-IRS official who Issa's panel is poised to hold in contempt of Congress on Thursday for refusing to provide testimony about her involvement in targeting conservative groups.

Issa said that Rep. Elijah Cummings (D-Md.), the ranking member on the panel, never told him about inquiries his staff made to the IRS about a conservative group that also claimed to be unfairly targeted by the agency.

Darrell Issa’s bluff on the IRS investigation is being called in a big way by top Democrats on Issa’s House Oversight Committee. In a letter sent today to Issa, they are demanding he explain in more detail why he continues to refuse to release full transcripts of witness testimony on the IRS scandal — and they are giving him until Monday to do so.

As you know, Democrats have been pressing Issa — the House GOP’s leading investigations ringleader — to release full transcripts of testimony given to the Committee, which Issa chairs, in the course of its investigation into the IRS scandal. Issa has released selected snippets of that testimony, and has suggested — without substantiation — that the White House directed the IRS targeting of conservative groups.

Cummings called on Issa to release the entire transcripts, which Issa said would harm the investigation. Cummings asked him for specific reasons, and demanded he respond by Monday. When Issa didn't respond, Cummings released the entirety of the transcripts.
