The point is that navies probe the defenses of other navies all the time. If that in itself was considered an act of war every country on earth would be at war with each other 24/7.

I'm a member of the unorganized Militia in good standing. I'm pretty sure apdst is also a member of the Militia. Under U.S. Code any male under 64 years of age and a former member of the Regular Army, Regular Navy, Regular Air Force, or Regular Marine Corps is a member of the Militia. When you become an old 64 year old geezer, then it's voluntary.
