Wait a kid can go get drunk and murder four people and not be charged for it because he is too rich? :doh I am so angry about this surely we cannot use someones upbringing to excuse crimes, I blame alot of crimes on bad upbringing but that does not excuse the crime in question.... why should we put people in jail that has abusive parents who didnt teach them to follow the rules? yet let a really rich kid walk free because "He was so rich he believed money solved all of his problems"

While I am very sympathetic to the people outraged over this, mislabeling it murder is just needless

I thought manslaughter was when it was an accident? I think when you drink take drugs and speed behind the wheel of a mass of metal that weighs tons... sorry but I just see it was murder /; but you're right I shouldnt call it that he didnt take out a gun and shoot people in the face

What makes you think that this young, pampered, totally irresponsible moron will not violate his probation and get the balance of the ten years of incarceration he is due? Would it make you feel better if the victims get the "satisfaction" of having this young moron locked up immediately and do not get any financial settlement?

Another way of looking at this is that the actual crime was operating a vehicle while intoxicated, not that the vehicle struck and killed/injured others. Imagine, for a moment, that the same irresponsible moron was sober, merely having had turned his head briefly while chatting with a friend in the back of the pickup and had the same "accident". Would that then make it non-criminal?

I say not, it should still be criminal to cause an "accident" that resulted in death and injury. But our justice system, more often than not, presses no criminal charges at all with sober, yet irresponsible morons that are distracted "unlucky" drivers.

The crime was not vehicular manslaughter, it was manslaughter resulting from intoxicated driving. Imagine, for a moment that the police saw this same moron, swerving as he drove, and pulled him over prior to the "accident" and found him to be driving while drunk. Would that make him any less guilty?

I say not, just more lucky that the police got to him before he killed or injured anyone. Since we base our justice (certainly the sentence severity) on the result of a criminal act, and not on the criminal act itself then DUI/DWI are only "serious" crimes for the "unlucky" offender.

The irony in this defense is insane...

The judge is basically proving the kid right -which in turn moots the purpose of the defense in the first place, because he's legitimizing the kids defense which makes everything the kid said TRUE, hence he's NOT insane and DOES NOT SUFFER FROM A MENTAL DISORDER.

This kid belongs in prison - at least - until he's 21, however I like 15 years a lot better.

Murder requires intent....

Did he intend to kill someone? NO - therefore it's not murder, it's at best negligent homicide and manslaughter at worst (of course it all depends on the states law and statute definitions).....

It's certainly not murder tho...

Regardless - that kid belongs in prison until he's 21 at least (which is typical in such cases as this one with juveniles).

Naw, not for life....... The kid is obviously an arrogant little prick (or at least that was the defense) but people change...... He certainly shouldn't be allowed to drive for a very long time but he is still a kid and kids do make mistakes but this mistake does not warrant a slap on the wrist - the kid belongs in prison to think about what he did and he can start from the bottom up when he's 25-27 years old then have 10 years of parole after that.

You really want to **** with this kid, put him in prison and take away his privileges - no commissary (meaning; TV, junk food, creature comforts) unless he works, no phone calls, no letters - no nothing.... Cut his "influenza" privileged clown ass off from the world.

I need to ask here. If the kid thought the drinking and driving laws did not apply to him, why would he think the needing a drivers license laws apply to him?

You don't go to prison for a 1st time DUI, however when you're on parole and get caught driving when your license is suspended (drunk or not) - you go back to prison to finish your sentence. If you have 10 years of parole - you go back for 10 years (that is only if he was sentenced to prison)..

The kid belongs in prison until he's well into his 20's but destroying his life because he was a clown at the age of 16 is just not right (probation is not right). The kid 10-15 years from now should have the opportunity to lead a productive "average Joe" life (after prison).... Hes a kid man....

It appears some want retribution for this - if that's the case may as well string him up right now...

IMO, you can blame the judge for this one - he was the one that slapped him on the wrist.

I disagree. Losing driving privileges for life may sound severe but so does the death of four innocent people. Who knows what the four deceased dreams and aspirations were or how many family and friends were forever affected by this.

Of course many say if he ignores the law regarding driving drunk he will have no problem driving without a license. That is true, but each time he gets pulled over he is going to get hit heavily. He will just have to use public transportation. It isn't like we are giving him the death penalty that he gave the four victims. They need to quit babying drunk drivers and nail them hard.
