Homeowner in Renisha McBride's killing to face murder charges[W:287]

Re: Homeowner in Renisha McBride's killing to face murder charges

Seeking help is a theory not a fact. No help seemed to be required for 2 hours and six blocks of travel.

It is neither theory nor established fact - it is the balance of probability.

Can you think of another, credible reason why an injured and disoriented 19 year old girl would knock on someone's door at the dead of night?

Re: Homeowner in Renisha McBride's killing to face murder charges

Driving drunk and/or stoned and crashing into a parked car makes you a victim? Why not seek help at/near the "accident" scene? Why wait two hours and go six blocks?
Seeking help could amount to honking the horn or screaming for help.

Or it could amount to knocking on your door.

Would you have shot this unarmed young lady in the face for knocking on your door?

It looks like someone needs to start rewriting a lot of old jokes.

Re: Homeowner in Renisha McBride's killing to face murder charges

If he felt threatened, he should have called the cops instead of shooting someone.

That's why it's murder
No that is not why it is murder, especially as it isn't.
Nor would the police have gotten there in time before she did anything.
Nor is that a requirement to be murder.

Regardless, the elements do not add up to murder, which would be why he was also charged with manslaughter, as that is what occurred.

That's exactly what the **** I would do if I were in a car accident and needed help. What would you do?

Stay at the crime scene and await arrest.

The same credible reason that they left the accident (crime) scene where help was available.

No. The shooter appears to have claimed that the shooting was accidental do you have evidence to the contrary?

And if you were in the middle of nowhere with no communications?

I find his claim a bit of a stretch, but then I don't know all the info.

Why?
It was Oh-dark-thirty in the morning. Someone had been pounding on his door. Tensions are heightened.
She may have moved in such a manner that it startling him, causing him to flinch and resulting in his gun discharging.
If so. That is an accident. Not intentional.

Why should I be wasting my time looking for any evidence to the contrary?

Obviously the shooter can claim whatever he wants to claim, but anyone who kills an unarmed person who knocks on their door, looking for help, has a serious problem which won't be resolved on this website.

The man is going to be put on trial.

I predict that he won't like the results.

Indeed they do, thus the filing of criminal charges.

You usually don't come to the opinion that someone is trying to break-in from simply knocking.

If that was you or one of your relatives that this guy shot, would you be OK with his actions?

That doesn't and shouldn't have any bearing on properly charging him.

Correct.

I don't welcome everyone who knocks on my door into my house, but I also don't shoot people for knocking on my door.

I believe that his guy has a problem which won't turn out in his favor when this case is decided in court.

We'll all have to wait and see how this turns out.

Still going with knocking eh?
So again.

She had the outer storm door open.

I believe that his guy has a problem which won't turn out in his favor when this case is decided in court.
What problem would that be?
Because as far as I can see his only problem is having to defend an aggressive charge for an accident.

We'll all have to wait and see how this turns out.
Of course.

Whatever.
Yeah sure, whatever. That is your fault for asking. The answer to your question should have been obvious from my sig.

The man has been charged and he will have his day in court.
Over charged.
Depending on what he says happened. He will take a plea to manslaughter or fight it in court.
It is highly unlikely based on what we do know, that he will be convicted of murder.

But since he has been charged with murder he may plead guilty to manslaughter, eh?

That is the point of overcharging now, isn't it?

Yep, lets wait and see how it works out in this case.

I predict that the perp pleads down and doesn't do any serious time for this.

Nope. I believe overcharging is wrong.
He should only face a manslaughter charge, and plea or take it to trial from there.

Tell it to the judge.
