Since it has no basis in the Constitution an amendment to make it constitutional is the only way it could be.

That is not the way any nation works.

And we have a US Supreme COurt to decide issues of constitutionality and they have done so.

All citizens, being equal in the eyes of the law, are equally eligible to all dignities and to all public positions and occupations, according to their abilities, and without distinction except that of their virtues and talents.

In the case of Obamacare, people and groups with influence are exempt from the law while others are bound by it, whether they want it or not. Do you not see any erosion here or do you just assume that Rights in the democracies will continue under the good will of its leaders?

I certainly do have several problems with the entire Managed Health Care law and you have wisely hit upon one of them.

One cannot separate our government from our nation and its people ..... after our the USA is a nation which has a government of the people, by the people and for the people.

The federal government creates the legislation. The federal government executes the laws enacted by that legislation. And the federal government has supreme judicial authority in America.

After think this over and coming down on each side of this a few times, I tend to think you are right to a certain extent. America is indeed governed by the ever expanding and more powerful federal government. State power has become fairly non-existent to where a state is nothing more than lines drawn on a map. But the people could change this if they so choose to do so. They do not have to keep sending the same people and the same political parties back to Washington to rule over them if they really desired not to do so. So if the federal government rules over the people and in a lot of instances goes against the peoples wishes, who fault is it that we let them do it? People are satisfied with being told what to do by those who say they know what is best for them. This way they do not have to decide what is best for them themselves. They just follow the dictates of Washington.

There was a reason the framers put into the Constitution what powers the government/congress had and what powers they did not. Then to make sure it was understood they added the bit that if the power is not listed, that power resides in the hands of the states or to the people.

We were once a republic where the people were represented by the House of Representatives which the people voted directly for. The states were represented by the senate, which the senators were to be chosen by the state, its legislature or its governor to represent the states and the states interests, not the people of the states. The 17th amendment change this to where today senators are not representing their states, they are just another House of representatives with a set of different rules.

The president was to be chosen by a set of electors where each state would decide how to elect them. But I guess the bottom line is that we have moved away from the Republic and more into a direct democracy which diluted the powers of the states and in that vacuum the federal gladly stepped in to where they are now omnipowerful and that power continues to grow unabated.

Therefore it is reasonable for me to deduce that you don't think that the federal government is the government of America.

The nation of the United States of America is comprised of fifty states and those are in turn comprised by cities, town, villages and other smaller areas. Each can have their own government which has its own area of authority.

According to the Constitution, perhaps the second most important document in the history of man, National Defense is the responsibility of the Federal Government. Health Care and food stamps were never mentioned..
