OMG! It's beginning to look like this story could actually be true. What an example of abuse of power as a result of the war on drugs.

actually most suits only reference official capacities. every suit against the postal service for employment discrimination has Patrick Donahoe as the defendant (Postmaster General), most suits by immigrants for failure to timely adjudicate their adjustment of status applications name the Secretary, DHS etc

But when it's a local government agency, the overarching party is generally named as well. In this case it would be either the city or county depending or both depending on who perpetrated the offense...

Setting aside the horrific journalism of calling this guy a "victim" in the second paragraph before all the facts have come out, what a crazy story this is.

And to top it off, the guy was sent a $6,000 bill from the hospital for the procedures.

Yikes! And people think Guantanamo is bad... I don't see your objection to calling this person a victim. What a pain in the ass (I'm sure I'm not the first to say this on here).
 
The article I read on this didn't mention he was leaving Walmart. I would think the only way to get people to stop shopping at Walmart and giving money to one of the richest families would be giving every person there a probe.

If X-Rays showed no foreign bodies inside, why would they continue with more probing?

When did the xrays happen exactly? We don't know exactly what went down. As someone else pointed out, it seems really odd that they would do a colonoscopy without doing everything that is actually required.

Another poster earlier had posted the calendar of events inthe order they happened. First an X-Ray, then other procedured, then another X-Ray.

I beleive the bill was $3000.00, not $600.00

Honestly, if this turns out to be true (and it does appear that it is), then the cops, the drs and the DA (or whoever authorized whatever) should all go down for it. The details though are pretty hard to believe, so it makes me skeptical and I would rather see exactly what went down here, wait for a trial. So far we are getting one side of it and denial of the details from another side. For all we know, it is possible that the guy could have went back somewhere to have those procedures done or actually requested them and is now claiming it was the cops. I just am not going to jump onboard here and say "oh what horrible people who deserve death or something else" before I know what actually went down, not just something in the news. Even the news can get things wrong.

And they do . . . OFTEN.
 
I doubt there can be any defense to this-and this is coming from an attorney who has been tasked with defending Law enforcement officers. She should sue both the employing agency and all involved individuals in their official and INDIVIDUAL capacities. A quick settlement of 100-150K would probably be the best course

I also see huge liability for the hospital and staff. They had no legal obligation to do this whatsoever, the search warrant was 100% invalid there on it's face being out of another country, and even then they continued past when it stated it expired. Nor can they claim any good-faith reason, as they billed him for it. Nor can they claim "no harm, no foul" since there was pain and suffering involved, he was twice irradiated against his wishes, was sedated (which always carries a risk) and performed evasive medical procedures.

The reason I see it as more important to go after the hospital and staff is because police have no reason to care about judgements against taxpayers.On the otherhand, a huge judgment against the hospital and staff would lead to future training - including by insurance carriers - in this regards.

I see thug-doctors as even worse than thug-cops.

The problem with what you stated is that it hasn't even been denied. Rather, an attempt to justify it.

On the contrary, one of those articles (I think it was the third one or last one posted, giving more details) says that the officers involved were only saying that they denied some of the details of what happened. They can't officially state too much about any investigation beyond very general statements as a policy, so they don't get to give any detailed explanations about what is or isn't true about what the accuser is saying.

"The bulk of the accusations"? Even if a small percentage of them are true it's a weird, evil and disgusting thing.
