Satanists Perform ‘Gay Ritual’ at Westboro Gravesite

What kind of Satanists hold a "gay ritual" and don't actually end up having gay sex?

The activists live out of state. It'll be problematic to say the least to get them arrested in NY because of the legal hoops to jump through, not to mention that to my knowledge none of the charges are felonies.
 
Couldn't happen to a nicer bunch. But WTF is a gay ritual?

WBC generally manages to stay on public property, where as they individuals were on private property, to my understanding
 
Still gonna be virtually impossible to actually arrest them.

I'm certain that any cemetery not owed by the government (such as Arlington) is private property, but at the same time I wasn't aware someone could be arrested after the fact when paying a visit to one -- by their nature, unless they're locked up or notices are clearly posted, aren't they public spaces? Wouldn't they need to be told to leave during normal hours before it becomes a trespassing issue?

They would have to prove some sort of damage was done to prove malicious mischief charge. Pretty sure there was no destruction of any property done there.

97-17-67. Malicious mischief.

The law says that there has to be something destroyed for it to be malicious mischief. Nothing was destroyed or harmed by this group.

Plus, trespassing into a cemetery would also need to involve some form of destruction of property here (from what I've read).

Although distasteful, there really isn't much they can do about this, and even if it ever made it to court, it would very likely not amount to anything because restitution and fines are based on how much damage was actually done, which was none.

I don't think it's worthy of being arrested or fined, but is just really stupid and immature.

Well that would be considered desecrating the grave. No one peed on the grave in this story. They just had a stupid ritual and made out. :shrug:
