“This is unheard of,” said Richard Behrendt, a former IRS estate and gift tax auditor who is now director of estate planning at Robert W. Baird & Co. Inc. in Milwaukee. “I can’t remember ever hearing of anybody going back 41 years to raise an issue. It’s really unprecedented in my experience.”

41 years seems rather bizarre but you must admit, it is amazing that they even found this after all that time.

The statute of limitations doesn’t apply in cases where no tax return was filed, Behrendt said.

Wonder why he didn't file? If he had, this would be a moot point. If ObamaCare is this efficient...we'll all be healthy, won't we?

Although I'm not aware of the full extent on this case I'd argue that an SOL defense could be applied in areas that would otherwise force a court to find in favor of the defendant.

I believe© that there is no SOL if fraud is involved. Failure to file might be the basis. Without fraud, the limit is 3 years (I think™).

Tax evasion is a crime ;)

That said, rest assured, if this were not a billionaire involved, this would not be an issue. Either way, I am sure as settlement will be reached at some point. Using minimum wage as the touchstone, that would be $4,055.46 today for whatever it is worth.
