Well this guy was a Cop.....and the book should have been thrown against him for Premeditated Murder. But one can see the Judge didn't even give him such a sentence. Which says something in itself. The Judge knows this is going to the higher court. So he knows the state is lacking.
He sentenced him to life, basically. Thirty-eight years -- w/special circumstances, no possibility of parole. I think you're wrong about the judge thinking something is lacking. And who doesn't appeal? Especially someone with his assets.
