I know you need to prove intent to convict, but don't you also need a crime first?
No. Conspiracy is a crime, you need intent and planning of some level. Writing a story or journal entry isn't intent, but if they have evidence that he was collecting materials then it's conspiracy. Assault is a "no crime" crime in that it is a threat of immenent violence, not the violence itself, it's the intent to commit harm that is illegal in that case.

So if I go to a bar and yell, "You're lucky I don't beat your ass" I should be charged with conspiracy to commit assault?

Big difference between beating someone up and blowing someone up.

If someone were to write fictitious events down, including how to make grenades and blowing people up, they would do it as the basis for a novel. They wouldn't write it down in a personal diary or journal. While it seems harmless, since he wasn't able to carry out his plans, the problem is he had the thought to do it. And obviously he had done research on how to do it. I am glad he was taken into custody NOW instead of AFTER 7 people potentially suffered the consequences.

Where are we going to allow the thought police to go?

It's one thing to make a mistake and get in trouble for it. On the other hand, it's completely different when you are up to no good. If you don't want to get in trouble, then don't do bad things or plan to do bad things. Plain and simple.

Life is too short. Treat others the way you want to be treated and avoid those who do not treat you with the same respect.
