I'm not so sure. Attendance at a charter school is a privilege, not a right. If these rules were in place at the time the student was admitted, and the student's parent(s) knowingly signed up for such rules, then they are not necessarily discriminatory nor a violation of any constitutional right.

Recall that HIGHER STANDARDS are the raison d'être for charter schools.
Your understanding of charter schools is amiss. By removing these students from the classroom not only are they discriminating, they are not improving the student's achievements.

They foster a partnership between parents, teachers and students to create an environment in which parents can be more involved, teachers are given the freedom to innovate and students are provided the structure they need to learn, with all three held accountable for improved student achievement.

Wow, this is terrible. It's a blatant violation of Title IX and it's gender discrimination, pure and simple. And it's made worse by the fact that this is a PUBLIC charter school in Louisiana.

I am looking at what laws have been passed. Perhaps you are the one that is looking at what your politicians are claiming instead of looking at facts.

Maybe what you are trying to say is that what is going on in the classrooms (teaching abstinence) has no weight on what is ACTUALLY going on in real life. If they were actually teaching comprehensive sex education we wouldn't have such a high rate of teenage pregnancies. Trying to minimize the problem to accommodate your party's policies is not something new. And now, Louisiana is compounding the problem by taking these already uninformed students out of the arena where they could possibly learn more and possibly creating more people that will need to be on welfare. Nice job.


No, I am saying I, nor any of my relatives, nor friends, who went to school in North Carolina during that time, were taught Abstinence only. If you are too politics focused to understand that politicians jabber on about this or that while other **** is really going on despite what they are saying, then sure go about being willfully ignorant.

Why the hell are we debating sex ed? Sex ed is not the issue. The latest salvo in the War on Women is the issue.

Any misogynist students who are offended by pregnant classmates (and yes, that includes other females) are more than welcome to drop out and become deadbeats. :)

No, I didn't mean students, although there will probably be more than one student that will be affected. The Charter Schools are supposed to improve Student Achievement. Each pregnant girl that the school expels, the school will have failed in improving that girl's achievement, thus the possessive use of the word student, because each pregnant girl that is being expelled is a student.

I think the school was wise to change the school policy even though I think there is nothing unconstitutional about the policy. It would have cost millions to defend their position and the benefits of such a policy certainly can’t be that advantageous.

People around here give their opinion as if it is fact without even bothering to check it out. It doesn't matter whether you think it is or isn't unconstitutional, this new policy in Louisiana is very much unconstitutional.

A public charter school in Delhi, Louisiana says that students who they “suspect of being pregnant” must submit to a pregnancy test. And, according to their written policy, “if the test indicates that the student is pregnant, the student will not be permitted to attend classes…” As we outlined in our report, A Pregnancy Test for Schools, policies like the Louisiana one clearly violate the U.S. Constitution and Title IX, the federal law that bars sex discrimination in schools.

Charter schools are not public schools, nor are they bound by the same rules public schools are. Attendance of a charter school is neither obligatory nor a right. If this was a run-of-the-mill public school you and all the pants on fie lefties would have a point.But they don't.

Kicking out pregnant students helps no one, if you want to curb teen pregnancy there is only one way, comprehensive sex education. Kicking pregnant kids out doesn't do that.
Is that like comprehensive immigration reform, a complete capitulation? Does abstinence ever work? Just checking.

I like the idea of letting people stuck in horrible schools decide for themselves how they will arrange for their educational experiences. If teen pregnancy is getting in the way of an education then let the school enforce its rule. Maybe someone else should go for a charter that says a teen must be pregnant to attend.

It's Louisiana, what do you expect, they're not the brightest bulbs in the box, look who they have as governor. They'll probably get sued by the ACLU, and lose.

This is outrageous and will never be upheld by a federal court.

I mean, wtf is next? Strip-and-cavity search females to determine if they are menstruating and allowed to be excused from certain sports activities? Why not just strip all females as they walk in the school's front door, poke a gloved finger "up there", make them pee on a stick, then hand their clothes back to them and drag the next naked girl in line?

A blatantly unconstitutional breach of privacy rights, and complete discrimination against females. It pisses me off that there are misogynistic troglydytes in charge of educating our children who would even think of such an abhorrant policy, let alone implement one.

When actions begin to have consequences perhaps we will move toward a time when making babies in junior high and high school is a bit less common.

The thing is, if the "plaintiffs" who agreed were minors, they were legally unable to sign a binding contract. If the "plaintiffs" who agreed were adults of the minor children, the contract is unenforceable not only because it was coerced, but because they cannot by federal law relinquish their children's constitutional rights.

Kandahar is the expert on constitutional law, but even a legal layperson understands that a coerced contract, or a contract which gives up the constitutional rights of oneself or others is unenforceable and illegal.
If they are minor children that let's go for statutory rape charges and see what happens.

Did you think for even a minute about the different types of girls that might not know who they had sex with? Did you forget that there was such a thing as rape, and that it happens fairly frequently? How about the fact that many girls who are raped keep that horror a secret because it fills them with shame? But thank god for assholes like you who are going to look at those girls and just assume they are 'loose', without knowing who they are or what they may or may not have experienced.

So this is the depths American conservatives can sink to. They are so huffed up on their own **** that they can't even recognize some of the most horrific struggles women and girls are faced with. I guess conservatives didn't put much thought to the fact that they might be kicking girls out of schools because they have been sexually abused. Scum like you might counter that a girl could just tell the school she was abused and they might give her leniency. In that case the options would be going to school or being forced to relive their trauma not own their own terms, but on some charter school administrators. No girl should ever have to go through that. Under these policies at least some certainly will.

As a society we need to protect those who are most vulnerable. The last thing we need to do is shame them, judge them, and take away their equal opportunity to a future.

Teen pregnancy has enough consequences as it is without assholes intentionally making it much harder by preventing the mother from going to school.
Maybe the policy is for the benefit of all of the other students.

For this e saying that this is a violation of the right to privacy of the students and it violates Amendment IV... I believe the court will look to VERNONIA v ACTON for precedence. (I did a paper on it a few years back, I am not a lawyer)

In that case it was ruled that students have a reduced right to privacy. Granted it was about drug testing, but it will be used.

NEW JERSEY v T.L.O found that "special needs" exist in public schools when dealing w children and "probable cause". That may come into play as well.

I personally think it is a discriminatory policy. Women cannot be fired for becoming pregnant, so why should they be able to be kicked out of school?
