WASHINGTON (AP) -- Ten young whooping cranes and the bird-like plane they think is their mother had flown more than halfway to their winter home in Florida when federal regulators stepped in.Now the birds and the plane are grounded in Alabama while the Federal Aviation Administration investigates whether the journey violates regulations because the pilot was being paid by a conservation group to lead the cranes on their first migration instead of working for free.
FAA regulations say only pilots with commercial pilot licenses can fly for hire. The pilots of Operation Migration's plane are instead licensed to fly sport aircraft because that's the category of aircraft that the group's small, open plane with its rear propeller and bird-like wings falls under. FAA regulations also prohibit sport aircraft - which are sometimes of exotic design - from being flown to benefit a business or charity.

Maybe if they only paid him "expenses" it'd be okay. You can see the point of the rules but they could bend them a little. The problem with that would be the precedent set.
 
Agree. yet some want a larger Fed Govt. to look after us.

Simple fix, the conservation group just needs to find a way to pay the pilot by not saying he is paid to fly (escort) the birds south.

It wouldn't even be "bending" the rules. All federal regulations as well as those charged with enforcing them half a lot of latitude in interpreting and enforcing the applicable regulations. So no precedent is set at all. Circumstances outside the norm, such as this one, can and are often made on a case by case basis. Its obvious the "for hire" rule requiring a commercial license is mainly due to concerns with the carriage of passengers, carrying freight or other commercial type activities.

The first question the morons that decided to ground this plane should have asked is "what is the intent of the regulation?"

This pilot has a license and is obviously a trained to pilot this aircraft, so getting paid, or doing it for free is irrelevant.

This is what happens when unions lobby for laws that say only certain people can make a living.

It's a disgusting abuse of power, typical of our out of control federal government.

Each of the states along the flight path should give the plane permission to fly across their air space, regardless of what DC says.

my guess is that it was a rule purchased by the commercial airline industry, who was losing business because of very small scale airplane owners making money on the side..

Yeah, commercial airlines, with all those union pilots, stewardesses, baggage handlers and mechanics.

Either way, it's sad that a person has to have a license to make money.

Your guess would be wrong. Most regulations like this are written in blood. Meaning an accident(s) occurred and the cause was an unqualified pilot for hire. Small time pilots wouldn't even dent larger carriers. Standards are always higher when precious cargo (people) is considered. As it should be.

Thats exactly what makes this move by the FAA so absolutely ridiculous. Sadly, I'd bet this pilot's license is now in jeopardy too.

That's what the constitution is supposed to be: a set of rules for governing the government.

In essence, its not so much more or less (personally think a ton less would be better) but properly managed government. This is why cabinet positions are so friggin important. The cabinet Secretary sets the tone and mission priorities. This Admin has pretty much let their's run wild with the EPA being by far the most out of control.
