Calling the state’s new pension and health benefits increases for employees unconstitutional, a Superior Court judge in Hudson County is suing the state in an attempt to get the hikes voided for all judges.

ROFLMAOoooooooooooo must be a haaaarvaaarrrd lawyer...this guy is a smacked ass if he thinks it should apply to everyone but him and his judge buddies
So do you consider judges that are lawyers rich guys ? they certainly make alot more than any other public employees..and hes WHINING...lol and believes in his godliness he should be exempt....funny stuff

So he's pissed because he'll have to pay for something he's receiving...is that about it? And in what manner is this unconstitutional? The article didn't say.

Is it reasonable to think there's a possibility that the suit could have any merit? Or is it an incontrovertible and foregone conclusion that the suit is entirely baseless?

Yeah, I saw this headline in my copy of The Star Ledger and I think its pretty arrogant. Everyone else is having to pay for their pension and health benefits, what makes judges so different?

It isn't "baseless" but he's going to lose. What I believe Simon is alluding to is the arguement that the legislation would punish a judge for ruling against them by raising their out of pocket costs.

So the solution would be to remove their pensions completely. There are no Constitutional rights to a pension.

No the suit does have merit if he fought it as unconstitutional for ALL PUBLIC employees...whats ludicrous is that he just wants himself and his judge buddies exempted from what HE SAYS is an unconstitutional law...hes a jackass

A lot of them have really good benefits, and as much cutting the budget as they are doing... I haven't seen any of them offer to take a pay cut or scale back their benefits.

It wasnt posted as a conclusion...I posted this because the JUDGE said the law is unconstitutional...but only wanted JUDGES to be exempt

You are right. I even have to back track on my post a bit. Does the law cover legislators also? If not he might have a point. That he only addressed this as unconstitutional concerning the judges is also the valid arguement. There is no conflict concerning clerks.

The arguement is that this goes against the seperation between the three ruling bodies. If this covered the legislature also, I'd say he has zero chance of winning. If not, I'd say it will be at least interesting.

Just for info...judges are not elected in New Jersey they are appointed
