A House Bill Would Create Open Borders if It Became Law. Why is Nobody Talking about It?

This, unfortunately is the future of our country, so whether the bill passes now, or waits 5-10 years, it will pass eventually , given the course we're on.


Yes, that is correct: The bill is an accurate harbinger.

We have been told by impartial demographers that the United States of America is changing very fast in its population profile.

Everyone should be a good sport and accept the inevitable.

Our great grandchildren will have a choice: Continue to do their best under the circumstances or leave. (That is the advice of many activists here in California.)
 
The bill would make it nearly impossible to deport anyone . I'm not surprised that the majority of congressional support comes from just three states- California, Illinois, and New York.

The Democrat's tactic on immigration is to claim they don't want open borders but support and create laws that do everything possible to entice people to come here illegally. They want to allow every phony asylum seeker access into the country. And as this bill and their desire to abolish ICE demonstrates they don't believe anyone here illegally should be deported.

This applies retroactively, so anyone who's already been here illegally for 5 years gets amnesty.

For the purpose of deportation, immigration judges consider whether a "serious crime" has been committed.

This section defines a "serious crime" only as one that resulted in a conviction and prison a sentence of more than five years.

There is no immigration clause in our federal Constitution. We should be upgrading Ellis Island and surrounding infrastructure.

It actually does, and it does so quite explicitly. Title VI of the bill repeals 8 USC 1325, the section of the US Code that criminalizes entry at places and/or times other than those designated by the Attorney General.

I watched the video. Seems to me that her immigration public policy proposals are well founded in common sense, and not much to disagree with there.

Why are the present Democrats so completely counter these immigration public policy proposals? It would seem that they should be in support of them.

Other crimes committed while in the country would still be enforced. It does not decriminalize, it simply limits the penalties.

And that is the problem with the hysteria over this. There are some good arguments against what is in the bill, but instead of discussing that, it is lies and distortions, starting with the OP and continuing on.
 
And not a word from you about the 400+ passed House bills that have been sitting on McConnell's desk collecting dust for many months now.

Three of those bipartisan passed bills collecting dust would strengthen the 2020 election against Russian interference.

And the clueless wonder why he's got the nickname "Moscow" Mitch McConnell.

I can understand the depth of the dust created from house bills awaiting discussion in the Senate if the bill emphasized in this thread is any indication. However, the leader of the Senate shouldn't be inactive on bills and should give them due respect. Maybe the house bills should be amended by the Senate and sent back to the house for further discussion on the amendments? I gather the Senate (McConnell) doesn't foresee anything coming from an amendment process in the Senate on this and other bills being held? Maybe the Senate should decide this? I mean, how can I grade either a representative of Senator on the job they are doing if bills are forever kept in committees?

“(1) INITIAL DETERMINATION.—Not later than 48 hours after taking an alien into custody, the Secretary of Homeland Security shall make an initial custody determination with regard to that alien, and provide that determination in writing to the alien. If the Secretary determines that the release without conditions of an alien will not reasonably assure the appearance of the alien as required or will endanger the safety of any other person or the community, the custody determination under this paragraph will impose the least restrictive conditions, as described in paragraph (4).

I agree. The bill should be further discussed in the Senate and, if possible, amended and sent back to the house. EDIT: Or if the bill is beyond hope, the Senate kills it with a vote. I mean, what else is congress doing these days except investigating the president?

There isn't any problem with "hysteria" if his point survives alleged exaggeration. And even without immersing oneself in the details there isn't any doubt that the "bill's intent is to drastically weaken governmental powers of border enforcement, to dramatically enhance prospects for delaying or subverting deportation of unlawful aliens, to attract many more millions to illegal entry, and to provide a means for illegal aliens to work, disappear, or find sanctuary for those with no more than 5 year sentences on their felony records - as well as providing millions of do-overs for the last 23 years of law of law breaking and a reward to any illegal who evades deportation for 5 years as an "amnesty".

This bill is an archetype of the AOC whack-a-doodle crowd: one that is on behalf of the interests of foreign citizens, and not the interests of the American people. Apparently they believe the words "of the people, by the people, and for the people" mean some other people than their own in our nation-state.

What a crock. The current procedure under this section is far more simple, and if anything, far too generious:

Current: the AG may issue a warrant, arrest and detain an illegal and may decide to remove or not.
Proposed: appaently the AG no longer has that power, it being reserved only for an immigration judge to decide who is arrested and detained.

Current: the AG must, if he chooses to impose a bond, to be not less than 1500.00 or as much as he deems sufficient to assure appearnce at a hearing.
Proposed: a bond can be imposed, but not so much that it could impose "hardship" (meaning one should not impose a bond that might too strongly encourage compliance by the unlawful with removal proceedings).

Current: the illegal here to do illegal work cannot be authorized to work, them being without a legal status.
Proposed: allow rewarding the unlawful so as to permit working indefinitely, to obtain the illegal loot that they originally sought by illegal entry.

Current: any sentence of greater than one year for an illegal or legal makes them a criminal, and they shall be taken into custody for deportation proceedings. There are only a few limited reasons for allowing release.
Proposed: only for felony sentences of greater than five years may (but not "shall") a person be detained for deportation, and one leaves it up to discretion by AG and/or his officers (judges) for whatever reason to decide if they wish to detain serious and violent aggravated felons.

Furthermore, consider this:

(3) PRESUMPTION OF RELEASE.—In a hearing under this subsection, there shall be a rebuttable presumption that the alien should be released. The Government shall have the duty of rebutting this presumption by clear and convincing evidence based on credible and individualized information that establishes that the use of alternatives to detention will not reasonably assure the appearance of the alien at removal proceedings, or that the alien is a threat to another person or the community. The fact that an alien has a prior conviction or a criminal charge pending against the alien may not be the sole factor to justify the continued detention of the alien."

The intention of this clause is to increase the likihood that a person who might otherwise be in civil detention and deported, has a much greater opportunity to escape and "live in the shadows" should they wish to evade judgements of deportation - perhaps using that "authorization to work" loophole mentioned earlier.

The assumption of release, which can only be countered by "individualized information" from the biographical history of a foreign person's life (of which may be little to no informaton, and purely self-reported) that can "prove" the person wouldn't report for deportation is more than absurd - especially so if a prior conviction or criminal charge (for example, rape or murder) is INSUFFIENT factor to justify detaining an illegal alien.

That this legislation is intended to check serious border enforcement and deportation of illegals (including criminals) isn't even a debatable proposition - it is self-evident in nearly every clause in this bill.

It absolutely decriminalizes illegal entry. That's the whole point of it. Being deported is not a criminal sanction. The worst thing that can be done to a person who has crossed illegally is that they can be sent back. No matter how many times they've done it. And yes, it limits the penalties -- it limits them to zero.

And anyway, if you want to punish anyone, start with

A) Strengthening e-Verify, give it as much resources as it needs to be EFFECTIVE.
B) Make e-Verify MANDATORY in ALL fifty states.
C) Penalize employers who either do not use it or knowingly hire illegals in the first place
D) Fix the immigration system so that it is not nearly impossible to come here legally.
E) Make the system reasonable in cost, and with that there's no longer much in the way of excuses to not come here legally.

Seeing as over 1 million legal immigrants come to the US every year your claim that it's nearly impossible to legally come here seems rather dishonest.

Just another example of how outside reason the democrats are. This is nothing more than a play for votes. Appeasement illegal hispanics in hopes of obtaining their vote on voting day. The goal is to get them the right to vote, illegal or not. You live here, you should be able to vote. Republicans need to be more vocal against these type of bills. Let the citizens know exactly what is going on.

Some of highlights of the bill should shock you. If passed and signed into law, the bill would effectively do away with deportations of criminal illegal immigrants, and require US tax payers to buy airplane tickets to fly convicted and deported foreigners back into the US.

• Section 701: "The Right to Come Home."
Anyone deported after 1996 has the right to new deportation proceedings subject to the law as defined by the New Way Forward Act.

• Section 102, P3: "Presumption of Release"
Immigration judges would be required to begin hearings with the presumption that the alien will not be detained, but rather freed - even if they've been convicted of a crime in the U.S., or have pending charges against them.

• Section 102, P5: "Bond Determination"
If an illegal alien is freed on bond, the amount of the bond will be decided by the "alien’s financial resources and ability to pay the bond without imposing financial hardship on the alien."

(You don't have that privilege as U.S. citizen)

• Section 102, P6: "Special Rules" for Vulnerable People
The following people can't be detained by immigration authorities:

- Anyone who identifies as LGBT
- Non-English speakers (
- Anyone younger than 21 or older than 60

• Section 102 (f)(2)(b):
- Disallows law enforcement from questioning anyone about their legal status
- Does not allow law enforcement (like Border Patrol) *to stop aliens from crossing the border illegally even if they're watching it happen.*

• Section 201(3)(A): Statute of limitations on deportations.
Would prohibit an undocumented immigrant who has lived in the US for 5 years or more from being deported.

This applies retroactively, so anyone who's already been here illegally for 5 years gets amnesty.

• Section 302(c)(i):

For the purpose of deportation, immigration judges consider whether a "serious crime" has been committed.

This section defines a "serious crime" only as one that resulted in a conviction and prison a sentence of more than five years.

• Section 501 imposes the same rules used by sanctuary cities (local law enforcement prohibited from helping federal immigration authorities)... for the *entire country.*

It makes every state a "sanctuary state."


And on & on it goes. The bill has 44 co-sponsors, who I'll name in my next post. Why are CNN, Fox, and MSNBC not talking about this?

There is a bill pending in the House that makes it illegal for water to run downhill. Why isn't anyone talking about this???
