Yeah, this was clearly a law aimed at punishing women for sex. Even pro-life conservatives shouldbe against such a law. (but don't worry, many will rage about this "activist judge" anyway)

[Judge] Sparks granted a temporary restraining order blocking the rules, then scheduled two days of testimony for early next month. He expects to rule by Jan. 6 on whether they will be allowed to stand going forward.

...Critics say cremation, and especially burial, would cost more and force women to have to cover the additional expenses, while funeral home operators also have worried about the added costs [of] interment and vremation. The Texas Catholic Conference, however, has announced that it is readying plans to allow free burial for fetal remains at Catholic cemeteries.

The baby in the womb wasn't willing to get a job to pay for the mothers care or pay for it's funeral so with that, I don't really see why you have an issue with this at all :shrug:
 
This is clearly an attempt to "guilt" the woman into recognizing the ZEF as a "human being;" to pressure her into reconsidering having the baby rather than having an abortion.

Burial is a ritual used to memorialize the passing of an identifiable individual, setting up a marked place for loved ones to visit and mourn.

When the State orders this requirement they are trying to compel recognition by every woman that the ZEF is a human being regardless of it's state of development.

Can you imagine trying to identify and bury every ZEF, from fertilization on up, whenever it's development ceases as the result of a miscarriage or abortion? :doh

How are they going to regulate this?

75% of ZEF's abort naturally as the result of a miscarriage; many women not even realizing they were pregnant when miscarriage happens during the earliest stages of zygote growth.

Even if they were to become aware somehow, are they supposed to preserve their menstruation material all the time and turn it in (to where?) on the off chance something the State might identify as requiring burial might be there?

And if they don't will they face either criminal charges or civil fines?

Hell, unless the loss happens in a hospital and the law requires medical facilities to examine the waste and report fetal material, how will the State even KNOW if a "death by miscarriage" has even happened?

It's an insane and insidious regulation, designed to indoctrinate women into thinking they are carrying a human being with all the legal rights thereunto from the moment of conception.

To force them to adhere to more rigid moral standards out of fear. To instill a feeling of regret at the "loss" of potential life through intimidation.

Hopefully the court will rule this an un-Constitutional violation of the woman's civil rights and toss it out. :twocents:

As noted above, despicable.

If a baby in the womb isn't going to get off their backside, get a job and pay for their mothers services in carrying them to term or for funeral costs (it's not cheap kids) then why should any of it be done?

Uh, ya'know... the government does tll families how to deal with their dead. Ya' can't bury 'em in the back yard or give 'em a Viking send off at the local lake.

It makes some restrictions in the interest of public safety, but to require specific methods? A bit different, wouldn't you say?

I mean, I can't drive my car down a sidewalk in Central Park, but I'd hardly describe that as the government dictating where I drive my car.

Truth is, I'm not quite sure I understand the article - or the point, but when it comes to public safety big gummit does have the say so, that's what I was sayin.

The failed law was supposed to cause the undue burden of a burial fee if a woman had a legal abortion.


BTW:
Over 90 percent of legal abortions in the US take place during the first trimester and over 90 percent of natural miscarriages also take place during the first trimester

The law is supposed to be punishing women for having sex.

Didn't know you see us as family, then again the only real life people I see using the term are slacker dudes with little real feeling behind it...

As far as moral compasses go, if you think it is despicable then it probably is quite legal and logical and I and most of the Republic see it as quite acceptable... :peace

The hard right Christiban legislatures in Texas are as fascist as they come. Fundamentalists citizens who keep filling the election collection plates of authoritarians...aren't disappointed. The wildest, most sexist laws pop out of the these legislators' darkest, creepiest corners of their twisted minds.

Texas would be a theocracy/police state if these radical politicians had their way.

We have to admit that disposal does seem a bit ghoulish , but then what becomes of miscarriages as minie pointed out, or early stillborns?

It;s laying religion over constitutional law, so they antis are just going to have to live with it the way they've learned to live with sending their kids of to war.

Nothing happens to miscarriages and stillborns. Nobody was ever going to apply this law to that.
