The Nomination of the Next Supreme Court Justice

If Hillary Clinton wins election it's my opinion that she will appoint a very middle of the road and mainstream justice probably somewhere in the Breyer and Kennedy spectrum of things.

First of all, if Clinton was to appoint someone like Justice Ginsburg or Sotomayor at the beginning of her term it would take up a good first six months of her Presidency due to a likely conservative backlash and the nomination process. This would make it hard to get any Democrat legislation through Congress.
I heard someone point out and I think it could be a possibility that if Clinton were to get elected she would go to Mitch McConnell and strike a deal that if she appoints a mainstream justice instead of someone like Sotomayor that he'll help get GOP support and not hold up the nomination process. By doing this she'll have a greater chance of getting at least a little Republican support for certain legislation. If she does appoint someone more like Ginsburg or Sotomayor then it is highly likely the FOX news/talk radio propaganda machine will fire up and someone like Glenn Beck will get on tv with a chalk board and a red phone...

Trump is a wildcard. He supports expanding medicaid, he's supported single payer in the past, and he really doesn't care about abortion or gay marriage so the kind of judge he would nominate is less predictable.

There is another choice, the Republican Senate can approve one of Obama's selections instead have giving Hillary a rubber stamp on her choices if the Dems win the Senate. There is sill time, maybe they should consider their options now.

Good point. Unless the Trump campaign totally implodes I think the GOP will continue to wait hoping for a Trump win.

Well I never expected them to do the smart thing, been a long time since I have seen that happen.

McConnell doesn't make deals with Democrats.

No matter who she nominates, the Republicans will obstruct. We know this from their pattern for the last eight years. We can plan on a long, contentious process, no matter who is nominated. The one that Obama nominated was a very moderate attorney who had Republican leanings and had been praised by key Republicans in the past.

However, Clinton is a moderate, so it's likely she'd nominate a qualified person who is not an extremist or has a hate mongering or disrespectful attitude, but is coolly objective when it comes to the law. She is a lawyer herself, so knows a thing or two what to look for in an unbiased judge.

No one really knows how a Justice will be, once seated on the Court. Justice O'Connor was a surprise for the Republicans, as was Souter. They turned out to be objective and cool when it came to the law, which the best ones are.
 
I think you're right about Hillary, but Trump wouldn't get anyone confirmed, or any other legislation passed, due to what republicans did to Obama. Dems will not forget that
