Santorum - not into porn...

Why is anybody giving a damn about porn?

Because a good porn can make you forget all that depressing **** and give you a moment or two of pure joy. . .

I'm aware of the Miller test. I'm an attorney. I took two semesters of Constitutional law, plus another semester just on the first amendment. You're absolutely right that the Miller test is the controlling definition of obscenity, but based on the precedent that I've seen, the Miller test does not ban pornography.

Ah, well you would know better than I if you are an attorney. I did amend my post a bit once I reviewed some of the precedent, but I admit I only have a Wikipedia understanding of this particular area of law.

Dude, I'm a peon right now. I only graduated a couple of years ago. When I'm a partner, I'll look you up. I do a lot of criminal work, so PI's are definitely a resource that interests me.

That's understandable. Construed literally, and outside of some kind of context, the Miller test looks pretty severe. It doesn't actually work out that way most of the time. I do know some cases that kind of pissed me off. For instance, there was this poor comic store clerk in Texas who got completely screwed by violating a local anti-obscenity ordinance because he sold another consenting adult some hentai involving a girl being penetrated by an animated tree. My professor actually showed us the comic. I mostly thought it was funny and ridiculous, but not at all offensive (although I am pretty jaded about stuff like that). And a minimum wage employee really shouldn't have to pay the price for doing his job.

Well I can't say for sure, but I would hope they understand that the video has artistic merit, pursuant to the Miller test. :)

Yup. The Japanese are totally bat**** insane. It's why I love them so much. If you want to get really crazy, check out the live action stuff they have involving cephalopod porn. No other culture on earth is that nuts.

Yeah, I love Japanese culture, big fan of their animation, and I'd love to take a trip there in the near future, and cephalopod porn, they do seem to love tentacles, so that doesn't surprise me in the least, but trees, TREES?

Having seen it, it looked a lot like cephalopod porn. But arguably creepier.

Hmm. I'm a liberal, and I actually agree with everything Santorum said there. Pornography DOES cause a lot of problems in society, including the ones he described. With that said, porn has been around for millennia, it's protected free speech under the Constitution, and it isn't going to be banned.

And Santorum himself contributes to misogyny and violence against women, so he isn't really one to talk.

When the Republicans contolled the White House for 8 years (2001-2009) and both Houses of Congress for 6 (2001-2007), does anyone remember Santorum and the GOP leading a crusade against pornography?
 
Porn is good for society. Countries were porn is legal have lower instances of rape.
 
Burka requirements can't be too far away.

Afghanistan has the Taliban and America has Santorum.
 
I think pornograpy is just as corrosive to society as Santorum does, but he's wasting time about talk of banning it. It's just like the war on drugs, it's like trying to put whipped cream back in the spray can. Hasn't he heard of the recent invention called the internet? All the porn in the world can be made in one studio and distributed world wide, and unless he wants to go through an IP address crackdown nationwide (he won't), it's just empty rhetoric.

He is even talking of charging people with a crime for viewing it. That is insane. His views are no better than Sharia law. He's planning on squelching freedom of speech right there. I think he was merely pandering to evangelical Christians when he made this bold statement. He forgets that if he wants others votes, he better back off from his porn stance. More than likely, he has ruined his bid for the Presidency after this stance.
