Here we go again. . . Z Defense Asks for Yet Antother Trial Delay.

Attorneys for George Zimmerman today filed paperwork, asking the judge to delay the start of his trial for six weeks.

Zimmerman, a former Neighborhood Watch volunteer, is currently set to stand trial June 10 in Sanford on a charge of second-degree murder.

He shot Trayvon Martin, an unarmed black 17-year-old, after the two got into what neighbors described as a fight Feb. 26, 2012.

Zimmerman says he acted in self-defense. Prosecutors say the defendant profiled Trayvon, falsely believed the teenager was about to commit a crime, followed and murdered him.

Defense attorneys last week said they'd ask for a delay because they need more time to hire an audio expert to counter the testimony of a state witness, who's expected to testify that the voice heard screaming for help in the background of a 911 call was Trayvon.

They filed paperwork, making the request today.

Circuit Judge Debra S. Nelson has twice said no to trial delays. She's expected to rule on the latest request Tuesday.

Also today, defense attorney Mark O'Mara filed new paperwork, again accusing prosecutors of hiding evidence that would help his client.

This time, he alleges that Assistant State Attorney Bernie de la Rionda lied to the judge when he told her April 30 that he had no other information or data from Trayvon's cell phone.

He did, O'Mara wrote, and they include photos of marijuana plants, a semiautomatic pistol plus text messages in which Trayvon wrote about being in a fight and asking about guns.

The judge previously ruled that de la Rionda had not violated rules of criminal procedure by withholding evidence, but she put off until after Zimmerman's trial ruling on whether the prosecutor should have to reimburse defense attorneys for the added work required to find out what he had failed to disclose.

For such an open and shut case, I'm surprised the defense keeps stalling. I'm also surprised they would waive the immunity hearing. The defense should be eager and ready to go to trial and show the world how innocent their client is.
 
As a thread already exists to discuss the delay which was going to be requested, the significance of this report is the motion for sanctions against the Prosecution.


O'Mara proved that the prosecution has withheld and caused delay.
It is highly doubtful the Judge will grant them as she has already shown her bias. But it has been proven nonetheless.
The only thing that may make her wisen up would be a ruling from the Florida 5th District Court of Appeals in favor of the Defense.


Very sad how the prosecution sat on this information and didn't give it to the defense.
We can also be positive they have more they haven't turned over.
Such as ping records.

The Prosecution has done nothing but make attempt at obfuscating the truth in all that they have done.
Yet Traybots think they have a strong case. Doh! :doh

I don't think it's unusual for defense counsel to "stall." It's not going to be easy to get an impartial jury here, so delaying tactics give it more opportunity to fade from media view. The fact that the state withheld information from the defense re Martin's cell phone is interesting. I wasn't aware the State could do that. I always thought there was full disclosure...especially after the ADA lied to the judge.

He may be found guilty of something, but to compare him to Arias? Just silly.

1. It is "usual" if the defense wants to taint the jury pool, as in this case (see: Zimmerman Family Media Tour, gzlegalcase.com)
2. It will not fade from the media. The sooner this is over, the sooner it will fade.

The defense is allowed to do that. As is the prosecution. When "The State" is after your ass in a situation like this -- it's iffy, I don't care what anyone says -- they must use every- and anything they can to try to even the playing field. The power of The State is awesome. No budget constraints; no time constraints. Only the very rich can compete with that.

Unlike the Ft. Hood shooter, Zimmerman isn't getting a paycheck. (Sorry to mention that, but it pisses me off no end.)

How about Casey Anthony?

She was later arrested.[45][46] Judge John Jordan ordered that she be held without bond.[47] On October 21, 2008, the charges of child neglect were dropped against Casey, according to the State Attorney's Office because "[as] the evidence proved that the child was deceased, the State sought an indictment on the legally appropriate charges."[48] On October 28, Anthony was arraigned and pled not guilty to all charges.[49]

The trial lasted six weeks, from May to July 2011. The prosecution sought the death penalty[10] and alleged Casey murdered her daughter to free herself from parental responsibilities by administering chloroform and applying duct tape.

Here, if it makes you happier... In 2003:
Music producer Phil Spector, known for his creation of the "Wall of Sound," was charged Thursday with murder in the shooting of actress Lana Clarkson, the Los Angeles district attorney's office said.

Spector remained free on $1 million bail while awaiting trial. The trial began on March 19, 2007.

The retrial of Spector for murder in the second degree began on October 20, 2008

Is that true? I thought all criminal jury trials needed unanimous verdict. Is there a cite?
 
Citation? Says unanimous for guilty where I'm looking...and majority for death sentence. ?

That is what I thought. Maybe he got confused with teh requirements for a death sentence.

Yes, it is very usual for murder trials to take a while to get through the court system. I gave three examples that I knew just off the top of my head, and all three took a while. If you don't like it, tough. At hte very least it shows it is not unusual for murder trials to take a while and 1 year is not long.
 
I realize I could probably do this for the rest of my life and it would still not be enough for you... I live in Illinois so here was a big one here (Mancow usedd to have him on all the time with his new GF - both seemed goofy):

In 1982 my girlfriend's step-father murdered his ex-wife. drove to her apartment, kicked open the door and shot her 7 times in the back while she was on the phone. drove down to the police station, gave them the murder weapon and CONFESSED. and it still took over a year for him to go to trial.

When did the prosecution notify the defense on who they(prosectuion) were going to use for tape analysis, provide the defense with a copy of the tape and findings?
