‘Stand ground’ man shot dead in Miami

By Associated Press | Wednesday, June 27, 2012

MIAMI — A man who won a controversial ruling under Florida’s "stand your ground" self-defense law has been fatally shot in Miami.

Police told The Miami Herald that 26-year-old Greyston Garcia was killed late Tuesday by a stray bullet during a shootout between rival gangs. Garcia was shot in his truck while driving to work. A 16-year-old boy also died.

Police don’t believe Garcia was involved with the gangs.

I think the way he was shot probably upholds the need for Florida's SYG Law.

Sounds to me like he was killed by a stray bullet and not involved with the gang shoot out.

Glad to see the SYG law is working to clean up the mean streets of Florida.

Right?

:peace

More effective than Chicago and DC's draconian gun control laws.

Hard to control guns coming into your state when the states next to you don't have the same gun control laws.

Sharon, I'm a bit unclear on what it is you're pointing out.

"Stand Your Ground" iirc is a Castle Doctrine law that allows you to shoot your assailant when attacked.

This man, Greyston, seems to have supported the SYG law.

He was murdered on his way to work by a stray bullet.

What I don't understand is how this is "karma," as if Greyston was somehow a bad man who deserved some sort of karma in return for his misdeeds.

If anything his unfortunate death only bolsters SYG in that people should be able to defend themselves from potential threats, like gang members.

Very sad.

Do you remember the details of the story? He woke to a guy stealing his car radio, followed him, stabbed him, went home and went back to bed. Then he sold the other car radios in the bag of radios the theif had threatened him with.. He was aquitted on SYG..

A lot is being written in Florida about rival drugs gangs using SYG to their advantage.. and to me SYG is nothing like Castle Doctrine.. I think Castle Doctrine is good law, but SYG is just fuzzy.

Oh I see. I hadn't read/heard of the Greyston story. I thought he had something to do with supporting the defense of the SYG self-defense law. This Greyston issue is new to me, so I don't have a working pov on it.

I guess I'm confused about the "Stand Your Ground" law, because the Google definition states it's a "Castle Doctrine/Castle Law." I'm not sure what the exact differences between SYG and Castle Doctrine are.

I think Garcia was caught in a gang war and was hit by stray fire.. Don't think he was murdered from the article..

Castle doctrine means you don't have to run away in your own home..

Stand your ground means you don't have to run away (no duty to retreat) in the street or any public place.

Theoretically if someone scared you or challenged you in a movie theater, you could pull your gun and blow them away.

I guess I don't have workable knowledge on this point on Garcia, and what to think about this issue and how it applies to M/Z/SYG.

Personally I think people should be able to defend themselves outside of their homes instead of running if someone tries to hurt/kill them. Even it were a generally benign place like a movie theater, if some's coming to hurt/kill you you should reasonably be able to stand your ground. I don't think it's right that someone would have to get up and struggle to get away from soneone else in the movie theater that wants to spill blood.

I don't think that SYG is applicable in the Zimmerman case because Trayvon had as much right to be there as George, because Trayvon was doing nothing illegal and because Trayvon was unarmed.

This is case is utterly senseless. God help George Zimmerman.
