The thing is, this is NOT a "constitutional question that has been raging for decades." At least not amongst serious observers...maybe it's been a debate amongst conspiracy nuts and various extremists.

Dick Cheney is pretty much the only person of any stature to suggest this, and not out of any legitimate philosophical belief, but rather to avoid an investigation.

Any ideas on why American citizens would attempt to defend that type of behavior? Do you think it's partisanship or something else?
