Federal agencies review funding to N.C. in wake of new LGBT law

At least five federal agencies are weighing whether to withhold funds from North Carolina in response to a recently enacted state law that blocks protections for gay, lesbians and bisexuals, and prohibits transgender individuals from using bathrooms that are not the same as the gender they were assigned at birth.

The ongoing reviews at the Education, Transportation, Labor, Housing and Urban Development, and Health and Human Services departments are not yet complete, and it is unclear how much federal money might be involved. But the Obama administration’s decision to scrutinize what White House press secretary Josh Earnest described as “both policy and legal questions that are raised by the passage of this law” suggests that the measure signed by Gov. Pat McCrory (R) last month could have major implications for his state.

Earnest said that “individual agencies are undertaking” the review, and the White House had not issued specific guidance on how to proceed. But he emphasized that President Obama said that “ensuring that individual Americans are not discriminated against because of who they love is something that the president feels strongly about,” and he was not surprised that North Carolina officials “are feeling some pressure” on the issue.

“I can just say that, more generally, this administration is committed to defending and even promoting the equal rights of all Americans, including LGBT Americans,” he added.

How does one enforce the policy of gender specific bathrooms when there are transgender people living in the state as well?

IIRC you go by how you were born biologically. I guess if you get caught in the wrong bathroom, it's a crime.

The North Carolina police have no idea how to enforce the new law.

"That's a very interesting question. We don't have police officers sitting at public bathrooms all day long," a spokesman at the Raleigh Police Department told me with a laugh. Over in Greensboro, the state's third-most-populous city, I received a similar answer. "We would respond if we received a complaint. It's not like we would be standing guard at bathrooms," said Susan Danielsen, a spokeswoman for the local police department, also suppressing a laugh. At the Wilmington Police Department, spokeswoman Linda Rawley said the law struck her as strange. "So that means people have to go to the bathroom with birth certificates? Yeah, that was curious to me." At the Asheville Police Department, spokeswoman Christina Hallingse noted, "We're not checking birth certificates. We just don't have the police power to be able to do that in bathrooms."

Since the law was enacted March 23, police departments across the state have been working to determine how they will enforce it. In addition to restricting bathroom use, it bans anti-discrimination protections based on sexual orientation. "Our staff, particularly our attorney's office, is trying to figure out what it all means," says Damien Graham, another spokesman for the Raleigh Police Department. "We haven't mobilized our police force in any kind of different way. We're still digesting." Public universities like Western Carolina University and the University of North Carolina are also assessing the law to determine how it will affect university policies, spokespeople from both universities said.

Co-Sponsor of House Bill 2 Dan Bishop sent WBTV a statement about the enforcement of the bill.

"As you have noticed," Bishop wrote. "There are no enforcement provisions or penalties in HB2. Its purpose is to restore common sense bathroom and shower management policy in public buildings, not to pick out people to punish. I anticipate that people will continue to follow long-standing custom now that we have reversed Charlotte's mandate on private businesses that turned bathroom management policy upside down."

Wouldn't it be nice if this administration applied the same withholding of Taxpayer money to sanctuary Cities for harboring illegals ?

North Carolina decided to protect it's children. Good for us. It doesn't surprise me at all that the Obama administration would be willing to punish heretics of the new Received Wisdom.

Meanwhile, sanctuary cities that actually flaunt federal law are celebrated.

People in those bathrooms will report to the cops. There's already lewdness laws.

Are there going to be cops who patrol outside of toilets? And how can anyone be certain that people will not abuse the power to report people?

You can't. but, why would they?

Are we to believe that when someone uses the wrong bathroom, they won't know they're in the wrong?

I am referring to the provisions of HB 2 that are causing problems with enforcement, I posted 3 links on the subject.

that's more a reflection of how totally unqualified all republicans in government are. They can't write more than a 4 page piece of legislation that is irresponsible beyond belief

this fear of abuse is why the ACLU says they've already received complaints by transgender that they're afraid to use ANY bathroom - lest they be accosted by gestapo without their 'papers' (birth certificate) on them. They can be arrested and later released without charges and the process is deeply humiliating
