From a legal standpoint the WHO owns the last remaining smallpox samples. The US and Russian governments are merely the custodians of it. The WHO allows them to conduct research on the virus at their facilities, in exchange for providing security so that it can't escape. But my understanding is that the WHO has the final say on what happens to it.
