Should Military Chaplains be allowed to perform Same Sex marriages?

No. A military officer can not even appear to be intentionally violating law.

But it's not violating any law, they are not filling for a marriage license, so there is no law being broken. A religious SSM is not banned, and should never be banned, unless you don't care for the 1st Amendment.

Yes, there is a law being broken. The chaplain would be confirming that marriage is between anyone, not just the legally defined one man and one woman. Being bound by it, he would be breaking it. He is never immune from federal law.

It doesn't matter if he signs the state marriage license, or what legal weight it holds. It. Does. Not. Matter.

DOMA defines marriage as one man, and one woman, legally, they are the only people who can file for a marriage license, and have it be recognized by the Fed. Having a religious, non legal SSM ceremony in no way violates DOMA, and is the military members religious right to have done if they so wish.

So then, you are saying that chaplain will also not be allowed to conduct marriage counseling with a homosexual service member, even if that chaplain is of a faith that accepts same sex marriages? How right is that? How can that in any way be fair?

A chaplain can perform counseling without recognizing the marriage, that isn't the same thing.

Why not? He's preforming a purely religious function, why should his 1st Amendment rights be taken away?

DOMA deals with the legal aspect of marriage, not the religious. A military chaplain can preform any religious ceremony he wants.

Because there is at least one anti- who knows his position is so weak that he/she has to spam the poll to give him/herself at least a minimal amount of self-esteem and belief in his/her position.

I fixed the poll to reflect reality. I am also tracking the spammer.
