but what if #1 then wore the #2 label, would #1 still be #1 or would he take on the common properties of #2, and would you need a special intelligence to then determine the difference

One has to ask that you clarify your statement, as it is far too vague to answer in any way unless one were to make multiple assumptions as to it's meaning.
