The money should be returned, with an apology from the girl, and then the girl's parents should take away her cell phone and make her mow the lawn, clean the gutters, and clean up after dinner for a week.

In short. she should lose a privilege and be put to work for a period of time.

An apology to the teacher and to the parents (for letting them down). Community service at the school for at least 40 hours.

Ok ok seriously. She should repay the money twofold. Return the $40, or whatever is left of it; get a JOB and work until she has repaid double ($80). The first repayment is a restoration of what she stole, the second is her lesson in what she did wrong by stealing someone's money: she stole someone's TIME and EFFORT.

And, if I was her Dad, she's grounded for a month, too.

I've never really understood what "grounded" meant.
What parameters does the word entail? No leaving a certain area? Certain privileges removed?

I agree that she should be charged for her crime just as anyone would, but I wouldn't have the same stance with an 8 year old, so for me age is a factor in general.

An 8 year old would not fully understand the nature of their actions as a 16 year old would, but they would know that they are doing wrong and they would deserve punishment for it. Just not the same degree of punishement.

To the OP - I think it would depend on if this girl had been in trouble before. If not, an ISS with restitution in the form of community service inside the school (school punishment of community service). Parents notified and an apology made.
 
She committed a crime against a teacher and while on school grounds, so for once the school would be justified in applying its own penalties. This certainly does not warrant expulsion, and I'd argue against any kind of lengthy suspension as well; her academic future and the opportunity to make a legitimate career for herself seems a little steep when weighed against petty theft.

I generally think the people in this thread have the right idea. Force her to pay the money back twice over, and then spend her own time and effort in community service-- as long as the school's detention requirement and the law's community service requirement did not conflict. If the details could be worked out to the victim's satisfaction, there's no need for the law to get involved at all.

Of course, if the teacher had caught her in the act, she'd have been perfectly justified in breaking her hand.

What ever punishment a thief/pick pocket is given. If it is jail then that is what she should get, if it fines and community service then that is what she should get.Of course all this is assuming this is her first offense.
