It appears the more I think about it the less certain I am that one or the other will happen.

There's always the remote possibility that something wildly exciting will happen during her confirmation hearings but it's far more likely they'll be boring and thus completely off the average citizens radar.

I'm curious to see what court cases her detractors think she decided wrongly.

She was chosen on three criteria.

    She has a vagina.

    The vagina was a latina.

    She's a judge.

Well, there was the one that some white boys trying to make fire chief filed. You see, all the white boys studied, all the black men knew the material so well they didn't study, so when none of the black men passed the cheif's examine, it could only have been because the test was racist. Yes, indeed, some of the black men complained that the papers jumped up as little crosses and set themselves on fire, right in front of the applicant. Now, naturally those guys failed, they couldn't turn in a pile of ashes as their test, right? So the fire department giving the test threw out the little racist test and denied the white boys their earned place as chiefs.

The spoiled little white boys, who never faced racism themselves, of course, filed a reverse discrimination lawsuit....and I can't remember if it was decided in their favor, as it should have been, but The Latina Vagina wrote a decision upholding that it was indeed a racist little test and was therefore unfair to the poor little black men that didn't bother to study the published test guides.

There's a thread around here somewhere that covers this.

I wish the black guys had videotaped their exams, it must have been cool and frightening to watch the paper stand up and self-ignite like that.

She was asked whether it was legal for the fire department to cancel the test because they didn't like the result. The issue wasn't whether the test was fair, it was whether they were legally allowed to cancel the test because they didn't like the result.

Also, she's more experienced than anyone appointed to the bench in recent time. She's got loads of experience, just pointing out.

    Re: Sotomayor

To expand from yesterday: in the Ricci case, she was being asked if it was constitutional for the Fire Department to cancel their test results because they didn't like the results. To ask her to come in and tell the Fire Department how to pick their officers would be an activist decision, as I see it. The judge is deciding whats best, instead of letting the department decide.

I also think that the utter scorn, sarcasm, and accusations of race-baiting in SA's post is indicative of part of the reason minorities usually don't vote for conservatives. I mean, calling an experienced and capable jurist, who graduated from Harvard and has decades of experience as a judge, the "latina vagina" is completely insulting to her, and can be taken to demonstrate a level of scorn for latinos in general. Not to mention, many latinos are proud to see one of their own elevated for the highest court in the land. To insult her so coarsely, and to dishonor her so, is something I could really see being held against conservatives.

Also, I really think the attempt to portray her as some rabid racist is ridiculous. She said she thought that because of her life experiences as a female latina, two groups that have usually had to overcome more to get where they are, might have more life lessons and wisdom than a white male, while you might not agree, does not make her a brown David Duke. Can we all grow up?

    Re: Sotomayor

    Nope.

In the first place, the Right is expected to question the appointments of a Leftist Administration critically.

In the second place, except for fringe characters, the Right is questioning her judicial philosophy, judicial record, qualifications, activism and so forth. Her ethnic background is irrelevant.

Since the Latino community is made up of normally intelligent people, they should be able to accept this.
