Assuming of course that we've already waterboarded them or done whatever else might be most expedient to get whatever information they might have out of them.

Since the US has no troops on the ground they have no horse in the race. Technically it is murder and mayhem within a sovereign nation, Iraq, so the responsibility for the costs of a trial and subsequent punishment should be theirs.

Because its a war crime.

Because our enemies remember that when they capture ours and our allies soldiers. Because giving them recruiting propaganda is a dumb ass "tactic."

And quite frankly, because we are better than that. Because we claim to have moral superiority over them. And by doing what you suggest, any moral legitimacy we claim to have goes right out the door.
 
This will continue to be a recurring issue for as long as Islamic militants commit their atrocities, and it's one that hasn't been solved ever since Bush sent captured Islamic militants to Gitmo.

In the history of human kind, we've never faced a situation similar to this, at least that I can think of.

What should the civilized world do with those that are as uncivilized as Islamic militants?

The United States currently has about 3,550 service members in Iraq, with about 2,750 of those aiding Iraqi security forces as trainers, advisers or support staff, according to U.S. Central Command data released to VOA.

Some 100 of these are special forces, according to defense officials. There are also 50 U.S. special operations forces in Syria.

From my perspective it's still the responsibility of the 'host' government. The cycle of hate will only be fueled if the US prosecutes.

Last though, I wonder how many will be captured alive? I am not implying executed on the battlefield, but literally captured alive.
Those that ran/ escaped-retreated from the last city ISIL lost, were all executed in horrific ways.

Ummm sometimes in war people get captured, and once you capture them it's a war crime to just murder them.

Based on who are the combatants, how the 'war' has been fought and publicized, and the nature of the conflict I would predict there will be much fewer POW's than most wars.

They should be tried, under modern law. We, the west have been claiming to have a better way than theirs for decades, trying to impose our will on them with questionable tactics; this time let democracy show it works, no more of this shipping them out of sight

Jurisdictional issues. If they've never lived here, have never been here, and have never committed a crime here, the United States doesn't have any grounds to prosecute them on.

most often American who commit crimes in other countries are arrested by the local police, making it a local issue, with the host country having jurisdiction.
 
Could you expand- from murder to being a technocrat- each one supports ISIL.

I know this isn't what you want to hear, but citizens have to be held to the laws of their country. Corrupt or no, US law is not international law. US courts are not international courts.

Since when does an American have American rights when in a sovereign country? You break the law in Mexico, you face their laws, their ways. You break the law in Canada, you do the time in Canada.

Any American goes to fight with the terrorists, let them try him for murder under Sharia law.
