Regarding the poll: Yes he is legally allowed, no he should not be allowed to get away with it. By which I mean, the america people should not elect Trump to be president.

That would be bigoted (no not racist as Mexican isn't a race but that's another subject) but it isn't a direct threat. saying someone 'should be' is different than saying I am going to.
Putting all that aside though Trump didn't say what you just said anyway.
