Utah judge removes lesbian couple?s foster child, saying she?ll be better off with heterosexuals | National Post

Last year, Utah couple Beckie Peirce and April Hoagland decided to get married. Last summer, in a decision legalizing gay marriage across the nation, the Supreme Court confirmed that this was OK. Then, Peirce and Hoagland wanted to take in a foster child. So, since the Supreme Court had signed off on gay marriage, Utah child services officials licensed the couple earlier this year. And, in August, Peirce and Hoagland welcomed a 1-year-old girl into their home, where she joined the couple’s two biological children. Plans for adoption, approved by the infant’s biological mother, were in place – soon, this would be a family of five.

But Wednesday, a Utah judge decided to end this plan, ordering the girl removed from her foster home because the child would be better off with heterosexual parents, he said.

If the judge's sole contention is based on the couple being lesbians, then we violated state lawbin denying the adoption.

From what we know of this story so far, this judge acted out of bigotry and not the law.

Is adoption a State right? I do not know and prefer to ask then look stupid. If States had laws on the books prohibiting SSM couples from adopting, were these made null and void with the recent SCOTUS decision?

I do know that up here(Canada) that decision would not have held any legality.

I don't understand what is wrong with these social conservatives. Why can't they just lives how they want and let others do the same? What went wrong in their lives that made them into such authoritarian assholes.

As someone who opposes abortions of convenience and who promotes less restrictive processes to enable willing adults to adopt abandoned and/or orphaned children, I hope this decision is quickly reversed and that this judge no long sits in judgment of similar cases/issues. Any person or persons who would give of themselves to provide a loving home to any child in such need should be cheered and encouraged and not disparaged. I hope this couple fights hard against this bigoted decision.

only mississippi (go figure) has a law with such a ban, and it's being done in thru the courts

this is foster care though, a technicality the judge is trying to get away with, and i'm sure he'll be overturned for that too

it's so bull**** how the bigots out there desperately try to delay the inevitable. He needs to be impeached

I guess you didn't get the memo. It's liberals who are authoritarians, statists, and approve of government interference in people's lives. Conservatives are all about individual rights, fewer laws and less government.

How is it that one judge's decision in one case has become "these social conservatives"? This has made the news because it's not ordinary.

Utah I assume is somewhat conservative, yet the Governor has come out against the Judges ruling.

Unfortunately this case involves minors so some of the details are not going to be released, all we have to go on is the story.

As to the legality, as I understand it the SSM decision has a tangential impact on States that may have made various adoption & temporary placement standards where the marriage in that home is a factor. Say, restrictions based on State definitions of marriage where being married was considered a suitable standard for a household. But like many things, State to State there are varying standards on who is eligible for adoptions & temporary State placements.

Because of that confusion all we really have to go on is the little information on the reasoning (released so far) on why this particular couple was denied the ability to keep a child they already had in their possession. The story is admitting that the court based the decision on the nature of the lesbian relationship.

Tells me that because the court did not stipulate some standard by State code, there probably is not one for this case / jurisdiction. You would think if there was a quick out that a judge could hide behind, they would take it quickly to avoid the headache. Making this decision boil down to the prejudices of the judge, confirmed by the story.

So... I hope this results in some sort of higher court action to protect this lesbian couple, that best I can tell have done absolutely nothing wrong to warrant losing this child.

My oh my it is quite difficult to wrap ones head around Fed- States rights- I see where a State will not have protections against discrimination based upon sexual orientation, yet a city can have such regulations protecting a person. Rather confusing form of Govts (Fed-State-City) and rights?????? Yes??

I agree with you to a point, but, we are talking about children here. It's not a case where we can let people live the lives they want because minors can't be assumed to know what they want.

I fail to see what their orientation has to do with it. Considering how many straight people have proven that they are incapable of that.

They are called Little People and they have a big village somewhere in L.A. and another great one in China although that one is caves and little houses.
I have never heard anything about red heads that would lead me to beleive that they warranted isnpection.
