Breach of constitutional law? Breaking election promises?

It's interesting how the US has wrongfully executed people, but no one seems to care. So basically in America you can get executed for committing no crime at all.

Killing one person is murder, killing 100,000 is foreign policy

NO-and doing that guarantees far more victims being killed.

What about espionage and treason? They dont have to result in success (for example if their information is intercepted) for the accused for them to get the death penalty. They just have to commit those acts.

Large scale drug trafficing is a federal capital offense in the technical sense (the death penalty is not often asked for).

Even still, there are two or three people on the Federal death row for purely large scale drug trafficing convictions (no murder conviction etc.). As to whether they actually get executed is another matter.
