Okay, enjoy being totally off topic.

You can report it if it makes you feel better. :) However, nothing will happen because I am addressing his response with a hypothetical question. CRUE CAB seems to have understood how the question relates to his statement. You don't. I'm not overwhelmed with shock.
 
That could apply to a 19 or 20 year old boy who has a 17 year old girlfriend posing for nude pics.

Why would I report it? Not my thread, and I don't care that you're off topic. I just pointed it out. Glad you and CRUE CAB found common ground. I'll go back to posting about the topic now. Have a good Tuesday!

You continually complain about it because you don't understand the points being discussed.If it bothers you, you can report it. However, as someone who understands how DP works, I can guarantee that nothing will happen because I am in fact on topic, and you just don't understand the points being discussed. :shrug:

I'm not complaining. Just pointing out that parents raping their own children has nothing to do with a child being victimized by another adult via porn. And as I already said, I'm not reporting anything. I don't really care that you, just pointing it out.

Your adherence to the belief that someone is "off topic" whenever you don't understand their point says different. Maybe you should understand that trying to define the parameters of a person's statement is not going off topic but addressing those statements? However, I doubt such a simple concept makes sense to your literal understanding of what is being stated. As I said, if you think I'm off topic, you can report it. It's derailing a thread and a violation of DP rules. However, that would mean that from now on, asking someone to clarify their statements through questions is off topic and in direct contradiction to the notion of "debating" a subject.
 
Thread is about punishment of convicted child pornography. Not high school dating of teens.

And I'm making a stipulation to those laws and the punishment for breaking them. Picture or videos of sodomy on a 5 year old is something quite different than pictures and videos of a 16 year old who lies about her age.

If you are caught with the former then the punishment fits the crime, IMHO.

I don't know if that is how it works though. Seems like based on the news I hear: Teacher caught with 4 child porn pictures gets 20 years; man who brutally beats an elderly woman gets 10 years. I go back and forth in whether I think the system is too sensitive to some crimes while too desensitized to others. I don't know where the balance should be, but it does sometimes seem too out of balance.

As for the punishment I think as long as child porn is defined correctly and logically, as others pointed out not teenagers together, I have no problem with mandatory punishment. I might even say if you are a relative or guardian of the child you get double sentence.
 
While I am for very stringent punishment of those who would have possession of child pornography, I must give pause to the worry that it creates as well.

We had a pretty big case here in Dallas where an informant and a couple of officers were arresting people for possession of plastic wrapped bricks of powdered sheet rock that they were planting on the accused.

I would hate to see (as I would also hate to give them the idea) a group of people getting arrested for kiddie porn on their computers that a hacker uploaded to them in the middle of the night.

The porn would be hard evidence. How would you prove that someone else placed it there unbeknown to the computer owner?

You couldn't, and you would be at the mercy of the prison population for many years for a crime that you did not do.

I don't think mandatory punishments are a good thing. We have judge and jury and they can ruke according to the specifics of a case. Thats how it should be. Perhaps guidelines, but nothing that essentially bypasses the judge.

True, I would prefer those cases be decided by a jury. I've seen more than a few offenders be let go on smaller charges because of a judge's own views on rape or sexual assault. Or hell even the judge here who gave a guy probation because he was too short for prison.
 
An old fella here - in his 60s - was given 20 years for looking at kiddie porn online.

My impression is the average federal sentence for first time offenders for merely viewing child pornography is about 5 years. State punishments (Arizona aside) are usually slightly less. There is a distinct possibility that the "old fella" had prior sex offenses when he as a "young fella"- and the court finally had enough of the fella.

Florida. No priors. He decided to not have an attorney. His minister turned him in finding a thumb drive with kiddie porn. No sex in them, pictures of naked little girls.

That can happen from time to time in the system we set up. But its set up that way so the judge can judge a case and hand out proper punishment.
