    I hope ISIL's perceptions aren't a consideration.
I don't want to look like defending these jerks but my instincts tell me that fighting for a cause in a foreign country should not be a crime at home. Should everyone who went to Spain to fight fascism have been charged when they came home? Lots of Canadians joined the US army and marines to fight in Viet Nam.
This is why I say there should be no American citizens captured there.

It should not be a crime at home unless the soldier is fighting for an entity that is an enemy of his own nation. In the case of ISIS, it is an enemy of all of the western democracies. It is, in fact, an enemy of liberty.

Literally. Why would you? Soldiers facing overwhelming odds and certain annihilation are allowed to surrender, but stateless fanatic terrorists have removed themselves from accepted civilized procedures. Just so you be careful of collaterals, and there's liable to be many, send them all to their Valhalla.

Well, I'd like another nation, another government, involved before I'd use the word 'treason', but I take your point.

That cause includes the overthrow of our government - making it either treason or rebellion, both of which are punishable by death.

The Islamic State collects taxes, runs a judicial system, issues passports, and is in the process of developing its own monetary system, making it more independently sovereign than most nations in Europe.

I'd simply suggest revoking their citizenship, passport etc., as well as black list them as terrorists barring them from traveling to the US. If they left assets in the US either their family will need to address upkeep of them or it will be repossessed (like cars and houses and such). There's no grounds to rendition them or kill them as spies.
I think if Thomas Jefferson were looking down, the author of the Bill of Rights, on whats being proposed here, hed agree with it. He would agree that the First Amendment cannot be absolute. - Chuck Schumer (D). Yet, Madison and Mason wrote the Bill of Rights, according to Sheila Jackson Lee, 400 years ago. Yup, it's a fact.

I'm not sure that makes them a state or a nation. The Confederacy did much of that as well, but never really became a nation.

AUSTAN GOOLSBEE: I think the world vests too much power, certainly in the president, probably in Washington in general for its influence on the economy, because most all of the economy has nothing to do with the government.
