Which of the following should states have power over?

Which of these should states have power over?

I've always wondered which of these the state has the right to restrict, determine, defend, expand etc. Be advised, poll is PUBLIC.

Abortion: No, its an individual Right due to privacy Rights.

Marriage: Marriage is a fundamental Right. Neither the Feds or the State has any power in this beyond ensuring that informed consent is given and no children are married off.

Slavery: No such right exists in any aspect of society.

Narcotics consumption: While on a personal level I think this should be outlawed to the fullest extent, it is an individual Right based along same lines as abortion and privacy. So no state right here either.

Prostitution: Individual Right: Again, privacy. State does have an interest in making sure that no disease is spread however so while they cannot ban it they can regulate it to the point where health safety is considered.

Adoption: Definitely a state right.

Trade & Commerce: Federal power. (note: I didn't say Right as the Feds have no Rights)

Immigration: This should be both a Fed power and a State Right as illegal immigration most definitely affects the States both economically, criminally, and health.

Education: I believe that everyone has the right to as much knowledge as possible. This is imo a combination of both Federal, State AND indidividual powers/rights depending on context.

Religion: Individual Right. No State or the Federal government should ever have the power to regulate it in any way. Note: I said REGULATE. It is imo perfectly ok for the government employees both low and high to display their beliefs just like everyone else. Doesn't matter if its on government property or not.

NOTE: This is just my personal opinion and does not reflect what actually is happening.

Is this about state rights? or is 'state' used as a generic pronoun to represent any government?

The government is an organization that can make any rules that they want to make. All of them. People refuse to acknowledge that governments doesn't have to fit within the parameters that you want them to fit into.

States don't have rights, that is a dangerous proposition. They have powers by consent of the people.
 
states have powers, the federal government only has powers delegated to it by the several states and the people. People have rights

the federal government should be limited to matters that states cannot handle (i.e. entering into treaties with foreign nations, war, etc) and not ones that state laws can handle.

I see your point but immigration is primarily a federal area not state

The easy answer is that section 8 Article I of the Constitution tells us exactly what powers the federal government has. Section 9 what powers the federal government doesn’t have and Section 10 what the states are prohibited from doing. Then to be safe the 10th amendment was added to insure the federal government remained a limited government stating what powers the constitution hadn’t granted the federal government is left to the states. Now Slavery was banned by another amendment so you can cross that one off your list. The rest, compare to what powers the federal government has and what powers were prohibited to the states. If they are not listed in Article one, then it is a safe assumption they belong to the state.

But that does not make it so, what the Constitution actually says and what is constitutional is determined by the SCOTUS. It is what they say, not the constitution that rules.

Drugs are definitely state, international relations obviously federal, immigration is federal.

Abortion I believe is simply within the right to privacy, therefor neither state nor federal? It's a right.

Education is a state issue.

The fed is not doing it. The congress and Obama should all be impeached for not doing their oath of office they took to protect our borders. If the fed refuses the state should take over

You miss the point. Arizona tried to protect their citizens because Obama refused. If Obama will not do it should the state protect the borders?

That isn't what my statement said, but yes I agree. Democrats (and to a lesser extent, Republicans) are taking away the rights of the peoples.

They aren't taking away rights of states, rather they are abridging state powers.

actually immigration is a state power.

the constitution only grants congress the power to make the immigration/ naturalization laws of the states uniform.

remember in 1787 there is no such thing as a u.s. citizen, only state Citizens, and congress cannot create a state Citizen.
