That isn't what my statement said, but yes I agree. Democrats (and to a lesser extent, Republicans) are taking away the rights of the peoples.

They aren't taking away rights of states, rather they are abridging state powers.

No they are abusing their power and ignoring the constitution. They are taking States rights away

Like I said, abortion is a right, government cannot and will not touch abortion (yes I know, a liberal saying "shoo government!" for something).

You make no sense. Abortion is a issue every election. A mother does not have a right to kill her child
 
as to the powers of the OP, all powers with deal with the individual life's of the people are state powers.

note ..but a person has the right to petition the federal government[USSC] to hear their case if they feel powers of the states violate rights.

one of the problems today is congress use it powers to try to right wrongs, instead of the court doing it which is their job.

Your thread title and poll question differ; states (or any gov't body) have no rights and only the power that the people allow them to have. Our U.S. constitution grants specific and limited powers to the federal gov't and reserves all other power to the people or to the several states. I will however discuss each item in your poll:

Abortion - as an elective medical procedure can be regulated by the state to help ensure that it is practiced safely and by knowedgable people. No state should be able to ban abortion or any other elective medical procedure.

Marriage - as a contract between consenting adults it is wiithin the power of the state to settle contract disputes.

Slavery - ownership of people should remain illegal and be enforced by all levels of gov't.

Narcotics consumption - I assume that you mean for personal recreational use should be left up to the individual. The production and distribution can be controlled by the state (as we now have for alcohol).

Adoption - similar to marriage, but the state may act as an agent for minors under the age of consent.

Trade & commerce - The gov't has far too much power in this area now; most trade regulation seems to serve to keep competition down and favor the larger existing businesses by imposing a ridiculous number of hoops to jump through in order for a new entity to try to gain a foothold. Outside of zoning laws and protection of the consumer (and general public) from dangerous practices or misleading claims the gov't should stay out of the way.

Immigration - the policy should be set federally and the states encouraged to help in the enforcement of that policy.

Education - the highest level of gov't involved should be the state but I prefer more local (county, city or school district control).

Religion - the 1st amendment covers this well by protecting the individual's right to freely practice their religious beliefs and prohibiting the gov't from establishing an "official" religion. The problem occurs when the religion defines taboos and the "religious" attempt to enforce those taboos on others. Your right to be faithful to your god ends where it impacts my right to live, act and believe as I choose.

I get where you are coming from, my point is that the federal government is ignoring the Constitution and violating state powers...only people have rights.

I've always wondered which of these the state has the right to restrict, determine, defend, expand etc. Be advised, poll is PUBLIC.

I was only able to vote for one. Which one is the correct answer? I voted for immigration. I think I see your point. A lot of them could be removed from the government's realm of responsibility. I'm pretty sure immigration would be something that impacted the safety of the citizenry and would require government participation.

What were you thinking?

I would argue, in terms of "should"...

Abortion*
Marriage*
Narcotic consumption
Prostitution
Adoption
Trade and Commerce*
Education*

* I actually think abortion, because of the intericate issues with it regarding whether or not the unborn child should be vested with rights or not, probably is best served at a federal level in terms of legality. However, I do think States should have some leeway in terms of how to work under the national framework.

* Marriage should be IF you removed it from most of the legal system for benefits. I would say if the benefit stayed, any state should be able to have it's own laws on what kind of "marriage" it recognizes but if your marriage is recognized in ANY state in the union then the federal government must recognize it for purposes that relate to "marriage".

* Trade and Commerce. Naturally this is one of those ones that is EXTREMELY broad and should be split between federal and state depending on the specific thing we're talking about

* With regards to Education, I think a generalized national standard of some basic educational requirements isn't out of place but that individual states should be able to have a hand on how their education system is setup and managed

Immigration is a national issue as it's an issue relating to entry into the country. Slavery is taken care of at a federal level via amendments and I think it should remain such.

Everything except slavery (disallowed, no questions) and religion (if they for some reason wanted to establish a state church, I mean).
 
States don't have rights. Only individual people have rights. There is no such thing as a collective right--that's communism.

The state has only one legitimate purpose--to protect people and their rights and property from the wrongdoings of other people.
