Maybe it's just me, but I can't help be struck by the irony that the Republican's should chose the issue of the President 'delaying' portions of the ACA as the basis for their civil law suit

Hmm, clearly my 'add a poll' ability seems somewhat impaired. I intended to add a Yes/No question

I can't help but be struck by the irony of President Obama and his administration constantly creating exemptions, waivers and delays, keeping the full impact of his "best ever" piece of legislation from those who've been waiting for it.

It's like rain on your wedding day.
A free ride when you've already paid.
The good advice that you just didn't take.
And who would have thought, it figures.

In a way it would seem so, while shedding light on the fact, that things that are bad can be made worse by the way they are executed. ;)

Keep them hungry and you continue to possess the means to reward for good behavior. That is elementary training procedure.

Love the Dr. Evil Icon.

The Republicans are probably pretty sure the case won't have legs, but the timing of it seems pretty sure to find it and the midterms in the news at the same time.

It's possible that these dullard, plodding, mental sloths have come up with something that will thrust the Obamacare problems into the consciousness of those that will be voting.

I'm not sure how this can even work.

Does this need to go to court to determine if it can go to court?

From my perspective, it can go to court and it will go to court. The deadline both for the individual mandate and the employer mandate under the ACA legislation has passed and by regulation the Obama administration has delayed full implementation, contrary to the written provisions of the act. As a result, the administration has taken unilateral action to ignore the legislative will of congress without seeking congressional amendment to the act. The case is in relationship to the powers of the executive to overrule the powers of congress to legislate. Other suits have gone to court challenging executive powers, so why not this one?

I think we should start a class action suit against Congress.

Actually, operant conditioning shows that denial of reinforcements results in a negative association.

Actually, the text of ACA gives the Sec'y of HHS the power to delay the implementation of both mandates.

Don't just say it - prove it - otherwise, I'm not interested.

You do not think it reinforcing to experience control of your urges?

(for the individual mandate)
26 U.S. Code § 5000A - Requirement to maintain minimum essential coverage | LII / Legal Information Institute

Sec 5000A (e) (5) - Hardship exemptions

Any applicable individual who for any month is determined by the Secretary of Health and Human Services under section 1311 (d)(4)(H) to have suffered a hardship with respect to the capability to obtain coverage under a qualified health plan.

For the employer mandate

Sec 1514 of ACA amends 26 USC 6056
Every applicable large employer required to meet
the requirements of section 4980H with respect to its full-time
employees during a calendar year shall, at such time as the Secretary
may prescribe,
make a return described in subsection (b).

"Controlling urges" is not a "reinforcement" according to Operant Conditioning

Actually, no - nothing you've posted proves that the HHS Secretary has the power to delay the implementation of both mandates as you asserted.

Maybe they are right. Maybe they aren't. I have experienced, what seemed to be such reinforcement. But I am not a behavioral psychologist and have not kept up with the art.

Sure it does

The first link proves that the HHS Sec'y has the power to define hardship exemptions, which is exactly what was done and the 2nd shows that the HHS Sec'y has the power to determine when the reporting requirements of the employer mandate are implemented, which is exactly what was done.

I predict that the GOP's lawsuit will not help the GOP.

It's a fundraising stunt.

I think I heard that Boehner/Issa want the legal expenses kept secret.

I predict next week they will attack Obama on fiscal responsibility and transparency.

That is transparent nonsense - I won't comment on your ability to recognize or acknowledge it as such.

In other words, you have nothing to support your assertion. Carry on and have a good day. And yes, I know, you'll claim victory now in the most unflattering of ways.

Re: Do You Think It's Ironic that the Republicans chose to sue Obama over ACA?

Maybe they are right. Maybe they aren't. I have experienced, what seemed to be such reinforcement. But I am not a behavioral psychologist and have not kept up with the art.

Put it this way

If the people who support those provisions supported them because they wanted to exercise control of their urges, then delaying would be reinforcement.

But do you really believe that the people who support those provision do so because they wanted them to be delayed? Wouldn't just not passing them be just as effective in making them wait?

The answer is obvious, and since those people do not want to wait, having to control their urge (to see those policies implemented) is not reinforcement. It is a lack of reinforcement.

IOW, you've got nothing

In fact, you can't even prove that the mandates have been delayed.......because they haven't

Re: Do You Think It's Ironic that the Republicans chose to sue Obama over ACA?

I predict that the GOP's lawsuit will not help the GOP.

Perhaps not - perhaps, however, it will assist in narrowing the apparently widely divergent opinions on what and what is not an executive power under the US Constitution. In that sense, it will assist the GOP, the Democrats, and the public at large.

I didn't know there were other suits on this same point of law.

I couldn't find any, but i may not be looking in the right places.

What were the specifics and what were the rulings on these cases?
