My reply was simply to the OP's general question, not the case in the article.

    You know, this question:

"So do you think the father has a legal right to see his baby born or be in the room?"

In the OP, the woman is not withholding visitation. She has him on a list of approved visitors.

No, if the mother says she doesn't want him in the room, then no. The delivery is not about him.

They should keep stripping men and fathers of rights. Maybe some of them will get a clue and not tie themselves down and slit their own throats.
A post so good, it needed to be said twice.

Anyway, someone going under any medical procedure whatsoever shouldn't be forced to have someone in the room with them if they don't wish for them to be there. If I were undergoing surgery and an ex-girlfriend demanded to be present, I'd be like, uh, no. Go away.

Not until it's fully out of her womb it ain't. You can hope it is and you can imagine it is, but truth is, it's no one's baby but the mother's til it's birthed.

I would think you, as a woman, would be able to appreciate some of the perks that come with privacy laws that allow you to determine who can and can't be present during a medical procedure.

Another interesting thing to think about is that if a patient is diagnosed with cancer, she/he do not have to inform their spouse. This is all because of HIPAA laws. I do not think this man's outrage and hurt feelings are more important than doctor/patient confidentiality, and no man (or woman) has the right to force themselves upon a person who is undergoing a potentially life threatening procedure.

If she had said that he cannot see the baby even after it's birth while in the hospital, then he might have a case, but I don't see where people can argue at all about any uninvited person being in the operating/delivery room against a patient's wishes.

Personally, I don't care if the operation is just to remove a hangnail. If my mom wants to be there and I don't want her to be, bam, end of discussion.

As for seeing the baby, people are flipping out as if the father is being prevented from seeing his child FOREVER.

I love comments like yours. The child is clearly both of theirs throughout the entire pregnancy. It can be no other way.

The mother determining who can be in the room is the result of a number of privacy laws. As a libertarian, don't you approve of systems that protect your privacy?
