    Spousal Rape - Crime of Rape, or Not ?????

    Good news for Virginians living in the 13th district who think that husbands should be allowed to rape their wives: State Senator Richard “Dick” Black has fought for your right to do so. And now he’s running for Congress.

    The rabidly conservative Republican was one of the state delegates who argued against criminalizing spousal rape in 2002, asking his fellow assemblymen, “How on earth you could validly get a conviction of a husband-wife rape when they’re living together, sleeping in the same bed, she’s in a nightie, and so forth, there’s no injury, there’s no separation or anything.”
    So there it is.

    Man and woman are married.

    Can a man rape his wife? Can he be charged with the crime of rape? Sentenced and sent to jail?
    That kind of rape.

    Is there such a thing as spousal rape?

    Does no mean no in a marriage?

    Or is DICK Black's view reasonable and valid?

    Than I hope that his ignorance is lifted in some sort if nontraumatic way and realizes that he is wrong. Attitudes like his create a pathway for social acceptance of barbarism and physical and emotional harm.

    I would ask he volunteer in a woman's anti abuse charity for a while to see what spousal abuse does to people. I have seen it and been part of rescue efforts. It's a heart breaking thing.

    Any sort of grey area MUST err on the side of caution. If we consider set A to be the set of sexual acts that are clearly consensual, C to be the ones that are clearly nonconsensual, and B to be the ones where it's not clear what the status is, then we must treat the set of acts in set B with the same scorn as those in set C. Trivializing set B is a key component of rape culture.

    This is kind of a silly question. We know that domestic violence is real. Nobody thinks it should be OK to beat your wife. Rape within a marriage is a form of domestic violence.

    The huge problem with spousal rape is that the law isn't homogeneous on the subject. Get the law straight and inform people.

    But really, if the spouse says no to sex there's the possibility of grounds for divorce (alienation of affection, also considered domestic abuse), depending on how often they say no. Quite simply, rather than steam ahead anyway the path is to talk of course, separate legally if necessary and then divorce.

    Oh, Jesus. This reminds me of the court ruling that decided that a woman couldn't have been raped because she was wearing jeans. See, removing jeans is really hard, so how could it have been rape if she had to go through the effort of removing her jeans?
