Spousal Rape - Crime of Rape, or Not ?????

Can a man be criminally/legally charged with raping his wife?

Dick Black is a raving lunatic. No means no outside of a marriage and inside of a marriage. Men do not have the right to demand or force sex upon their wives.

I fail to see the point of the thread, quite frankly. If the question is anything other than the very definition of a no-brainer, then there's agenda here. So it's a game. Who's having the most fun, so far?

Well, there are people like clownboy (what an apt name) who thinks that rape in marriage need not be charged as rape. There are people out there who think one spouse can't rape another, and then there are people who think if they can rape their spouse then that rape should not be a crime.

And then there are people like Jerry who bangs on about proof as if that says anything about whether it should be a crime.

How is a crime proved? It's proved by arguement before a jury trial to a point of no reasonable doubt, as all criminal trials are.

I submit that whoever identifies extenuating circumstances here, is someone to be safely ignored.
 
I overstated that a bit, sorry. What I mean is, if intimacy is declined for more than a week or two without a good explanation, there's a problem and there's going to be a discussion... and some kind of resolution within a reasonable period of time. Cutting off your partner without a damn good reason, whether done by the man or the woman, is a major breach of the marital relationship.

Can a man rape his wife? Can he be charged with the crime of rape? Sentenced and sent to jail?

No means no, but if the marriage is bad enough that either doesn't want to have sex, and the other still does, it would be time for either some serious counseling to try and resolve the issues causing the problem, or they should part and go their separate ways.

Would seem so. Though NY's divorce laws were designed to make a divorce very difficult to get so other states probably aren't as bad.
At one point it got so bad that couples that wanted to divorce lied in court - claimed no sex in a year or admitting adultery when in reality they didn't - to get them.

I guess that could be the case sometimes.

I actually suspect it's the case more than most of us realize. I've had more than one man friend who has told me pretty personal stuff about their marriages. I'm frankly shocked at how many women decide they don't like sex anymore, once they are married. It's really kind of sad.

It should be as easy to get divorced as it is to get married, or as hard to get married as it is to get divorced.

I suspect that a lot of those women never really liked sex and just pretended that they liked it. I don't see how you can go from liking it to not liking it just because you got married.
 
I think it would be harder to prove. But rape is rape and rape is wrong.

I agree, it would definitely be much harder to prove. DNA wouldn't count for much between two people who are married.
