    A formal review process for dozens of men being held at Guantanamo Bay without charge has begun as part of an effort to close the prison, the Pentagon said Wednesday.

    The U.S. has not yet said how many of the 164 prisoners now at Guantanamo will be reviewed. More than 80 have already been cleared for release or transfer but are still held either because of restrictions on releases imposed by Congress or because they are from Yemen, which is considered too unstable to take former prisoners.

    The government previously said that about 46 prisoners are being held in indefinite detention under international law. That generally means they can be detained until hostilities end

    since this is perpetual war, that is a death sentence. Understood that Yemen is the current hot spot (AQAP), but if released we'll drone them.
    We are pretty liberal with our defintion of "militants" there.

    Detain them until the extremist factions which declared war on the US stop their war against us. If we are going to abide by LOAC then we should abide by LOAC. Any detained prisoners of war can be detained indefinately as long as the conflict is still ongoing.

    Release them to the authorities in those countries we found them in assuming we are no longer at war in that country.

    First, there is no war. The "war" is a metaphor. Second, even going with this hypothetical war approach, there is no one to surrender and no discernible victory. So, in essence, what you want is a license for the US to lock up anyone it wants (with out any due process) for life.

    ....and I take it you know this having a first hand account the the Quran? Are you a scholar of the Quran? Have you read it at least once? Or, is this something you have heard and you are merely perpetuating myth, which in Christian circles is gossip and sin in the eyes of God (you know like bearing false witness or murder)?

    I was thinking the same thing, nearly. There's a lot of closeted dictatorship support in the US apparently.
    Somehow definitions got scrambled. If you invade a country are you allowed to call anyone resisting the invasion 'insurgents' or 'terrorists'? Smacks of dishonesty.
