He could be:

 
teacher said she had admonished the student about his hugging behavior before
kid did the crime. now to pay the fine
mom can always send him to school in another district so that he can graduate on time
 
It doesn't matter what we consider sexual harassment. It's what the school district considers sexual harassment, and obviously, and grown student, coming up behind a teacher and hugging her, even after she's warned him about it before, constitutes sexual harassment.
 
Well my wife likes hugs but she didn't like what she saw of the teen's hug- from BEHIND, arm wrapped around the upper breast of that teacher. It seems quite apparent the teacher never saw it coming and didn't give her permission for it. She is seen pushing the teen away. (was on the news last night)

The year long suspension isn't for just a hug. The teen has been suspended before, apparently long term and repeated. Most schools have stronger punishment for each additional infraction, sort of like the three strikes rule in the adult world.

So at the very least he isn't a sweet affectionate boy who gave a single hug and is out for a year.

A simple life lesson for us all- just like in here, if you have built up enough infraction points to see the line without standing up, perhaps you shouldn't call the mods names and question their actions upstairs.... :peace

It doesn't matter what we consider sexual harassment. It's what the school district considers sexual harassment, and obviously, and grown student, coming up behind a teacher and hugging her, even after she's warned him about it before, constitutes sexual harassment.

In other words just bend over and accept any schools policy as gospel from above.:roll:
 
The student was not smart especially when:

The teacher claims that his lips touched her neck, which he denies. She also alleges that she had warned him in the past about inappropriate physical contact.

Even though he disputes the warnings the teacher claim. I don't see it as sexual harassment personally, but he was warned and did it anyway. Does that mean it's sexual harassment? No. Is a year long suspension appropriate for such an act? No. The weird part about this is, many schools provide condoms to students, start sexual education in grade schools, teachers demonstrate and have students practice putting condoms on banana's in class, (I don't know if that's the case with this particular school so yes, I'm generalizing a bigger point not attributed to this particular case, so phbbt! :2razz:) and then suspend a kid like this under sexual harassment for a "hug". Interesting to say the least...

I handled a large numbers of such cases. Some had merit, some did not

one case that did involved a woman who was "dry humped" by a male employee after he had asked her if he bought her a french maid's outfit (They came across a catalog that featured said costume) would she clean his house. He had health issues that she knew about and she made some comment suggesting he couldn't "do anything". He got upset and when she bent over to pick up some material, he, with an erection, dry humped her. He was suspended but a grievance handled by a female who didn't like the target of his attack, reduced the suspension to a minor warning. After that the male employee would ask the victim if she enjoyed it and he was going to do it again.

What made it worse was the same male had a history of harassment.

on the other hand, many cases were bogus-before I retired, I took the deposition of a woman who was fired for incompetence, and she claimed ti was due to her being female. Dozens of coworkers-especially females-said otherwise
 
I was under the impression that any kind of unwanted touching could be labelled as sexual assault, or at least regular assault?
 
The hug seems inappropriate (based on the limited available info) but the punishment seems too extreme.

The sexual harassment laws in California seem quite reasonable. That does not mean that they are always interpreted and enforced properly.

Okay, maybe suspension is rather harsh for a hug, but still, he was warned about inappropriate and unwanted touching in the past according to the article, and the teacher had to physically push him away from her?

Right, you can't force hugs or other touching on other people, regardless of whether a person might consider that "bitchy" or not.
 
An uninvited hug from behind, yeah I think that could qualify as sexual harassment; especially if the student touched her breasts or his lips touched her.
