    I notice there is a sexual harassment policy for staff but I didn't notice anything mentioned for students. It's probably in the parent/student handbook.

    IMHO, walking up behind someone and grabbing them like this is not sexual harassment, it's sexual assault.

    Well, like I said, I'm not sure where the law draws the line between harassment and assault in these situations, but you could be right.

    The punishment seems over the top for me. It wasn't like he went back in after she pushed him, and it looked like she had a smile on her face. Not a smile that she liked it, but a smile that said, ''boy go somewhere with that''. So now he will most likely end up a statistic and drop out of school all together! Then again, a 6yo boy got suspended for kissing his peer on the hand. Geesh!

    Well I thought that if someone made it clear they didn't want a person to touch them in a certain way and the behavior continued that was some kind of assault or harassment, maybe not sexual though. Am I wrong?

    some touching is construed to be sexual in nature. If a man were to deliberately squeeze a woman's breast or reach under her skirt and squeeze her crotch that would almost certainly be deemed to be sexual in nature. However, in a case I consulted on-two females working in the PO -a supervisor and a subordinate, got into an altercation. The craft worker claimed she was the victim of a "lesbian attack" because the supervisor put her hands on the employee's breasts. Evidence showed that the boss was being berated by the worker and the worker was "in her face" and the supervisor merely pushed the irate worker away and that push resulted in open hands hitting the breasts of the worker. The court dismissed the claim finding there was no evidence of a sex based action

    And hugging from behind, such as in this particular case, and nuzzling the neck, as is alleged, wouldn't be?
