There are clear differences.

Iraq was in violation of a cease-fire agreement with the US and its allies. Syria is not.
Saddam Hussein followed a very aggressive foreign policy forming a threat to the region. Assad is mainly concerned with Syria itself (and to a lesser extent Lebanon).
Iraq tried to assassinate a former US President. Syria didn't.
