I don't know how much an 8th is...but if it's what a person would typically buy for themselves, nothing should happen. If it's what a person would typically sell/distribute to others...then they should pay their sales and excise taxes on it, and nothing else.

eight=1/8th an ounce,or by california standards what you get for30-60 bucks.
 
What should happen to someone caught with an 8th of marijuana?

They should be congratulated for helping the economy after we (finally) legalize it. It is stupid that it is still illegal. Coffee and soft drinks cause more long term brain damage than the ganja.
