This is already illegal, covered under existing anti-discrimination laws
We need new legislation to make this illegal
It's poor judgment on the part of the employers, but doesn't need to be illegal
It should be legal, so that employers can conduct a thorough background check
My point is that sometimes people will do things like this because they NEED to. Not because they want to. Stupidity and/or smarts takes a backseat in times such as described above.

I love the NSA. It's like having a secret fan-base you will never see, but they're there, watching everything you write and it makes me feel all warm and fuzzy inside knowing that I may be some person's only form of unconstitutional entertainment one night.
basically, it has the potential to spread like coercive drug testing at time of hire. that started small, but now it's pretty much everywhere. i'd prefer to see the workforce protected from this kind of invasive nonsense.
